Anyone know anything about speeding penalties?

My son, aged 17, passed his motorbike test the day after his 17th birthday. He is generally a pretty safe driver, but being able to go above 35mph for the first time went to his head rather...
Anyway, he got pulled over for speeding at 82mph in a 50mph zone a month after his birthday...:eek:
To be fair, the road he was coming down is 50mph and then becomes delimited after half a mile, so people do bomb down it. This is not an excuse but he was pulled over just before the national speed limit sign...
In a way, I am pleased that he was pulled over - I'd rather get a call saying mum, I've been stopped by the police than one from the hospital, God forbid. It has frightened him and he is now far more sensible about his speed.
They took so long to get in touch with us we thought it might have been allowed to let it pass, but no such luck - he has received a summons. The policeman who pulled him over did say he would have a summons, we just didn't realise it would take this long.
He was going 32mph over the speed limit. He is obviously looking at a hefty fine and some points. My question is, is he likely to get a ban, does anyone know? At his age, 6 points is an automatic disqualification I believe. If an "ordinary" motorist would get 6 points and no disqualification, is there any case that he should get 3 points (in other words, that it would be unfair to disqualify him if this was not normally a disqualifying offence)?
I am not trying to get him off, nor am I trying to enter a plea of "boys will be boys"! I'm just wondering if anyone has any experience in this area who might know what the likely outcome will be? And also, if he pleads guilty now (we got the letter today) does this make a tremendous difference to his fine?

  • Unless he can make a case to the magistrates that he needs his licence for work etc and financial hardship will ensue if they take his licence away, then I would be be preparing him for a ban.

    Given that he is only 17, and unlikely to be earning a lot of money, if any, then the fine is unlikely to be massive.

    30mph++ over the speed limit is going to lead to a ban for a proper (experienced) driver, let alone a kid who has only had his license for a couple of weeks.

    He will certainly receive a ban and have to retake his test.

    As his parent, you should be hoping it is a very long ban and he doesn't get back behind the wheel for a very long time, if he does, that phonecall from the hospital is a very likely call.

    How can you possible call him a safe driver?? :confused:

    Not always the case - I received 6 points and a £200 fine. I turned up to court and grovelled for all I was worth.

    He will almost certainly be banned i would think.
    Quite rightly as hopefully this will be a lesson he needs. I work in this line so have seen far too many times the consequences, particularly for inexperienced riders/drivers. It's not worth thinking about...

    This is someone whose had his licence 1 MONTH - how can the court justify giving him anything other than a ban?

  • If theres a ban, thre will be the test again too (inc theory I believe).

    I usually stick up for speeders - we all do it, but 82 in a 50, and within a month of passing his test is pure stupidity. Maybe a ban will make him think and slow him down.
  • I'd try the peepipoo for some objective advice on possible avenues to reduce the blow.

    As others have said a ban seems likely but i'd try there as if there is any way to limit the damage they'll know.

    As for the speeding its easy to jump on the high horse but i'm sure most of us have done things that are reckless and stupid so i don't want to be too judgemental, all though now he might appreciate the old adeage "don't do the crime if you can't do the time" a little more.

    Incidently i do know of many 50mph roads where it is possible to do well over 80mph without incident - but thats another arguement.

    Did he get a NIP within 14 days of the offence? and/or did the summons arrive within 6 months of the offence?
