    Hi
Wondered if anyone had come across their bank changing their credit card without consent or prior knowledge. We had a BOS Visa card and without any warning whatsoever were sent a notification that the balance had been transferred on to a Mastercard.

Bank of Scotland and Halifax no longer provide Visa credit cards to new customers and they are changing all their existing Visa credit cards over to Mastercard when they expire. Banks do this from time to time.

The account nos etc had all changed, but we had absolutely no knowledge of this until the new card arrived through the door!

They don't have to advise you in advance. The letter that comes with the new card will explain the changeover.

Does anyone know the legality of this

    Yes. Quite legal.

, we have signed no document to allow this to happen.

You didn't need to. You signed a credit card agreement with the bank when you applied for your original card. The type of card issued is at the bank's discretion, unless they offered you a choice, which I don't believe Halifax/BoS ever did.

, Surely the Visa agreement is now null and void and a new agreement would have to be set with Mastercard (which has not happened),

You never had a Visa agreement in the first place. You had a credit card agreement with Bank of Scotland. This still stands, so you don't need a new agreement to allow the card to be changed to Mastercard.

therefore does a contract actually exist?

    Of course it does!!!!

Have the bank acted outwith their powers

    No!

or is this another of the banks hidden clauses?

It's not hidden; it's just that you didn't know about it. It's often in the terms and conditions that they can change your card type, and even if it isn't specifically mentioned it's still perfectly legal. There certainly won't be a clause promising never to change the card type without your prior agreement!

Surely they cannot take silence as agreement i.e. if the card is used it is taken that there is agreement.

Of course they can. If you don't want a Mastercard then just clear your balance and send the card back.

Another point is that the original agreement was signed before 2007, the Mastercard arrived after 2007, does this smack of the banks trying to rectify a situation by the back door, as we have all heard about credit card agreements taken out before 2007!

This is completely irrelevant. Your original credit card agreement still stands.

... banks are tending not to use the visa branded credit cards anymore.

Barclays, which is Britain's biggest credit card provider, still issues Visa credit cards. They also issue a couple of Mastercards, although these aren't heavily promoted. I would be very surprised if they ditched Visa for Mastercard altogether.

Yeah barclays are still big with visa credit cards. I wonder if some banks are not using visa credit cards anymore by choice.

I dont own a credit card so ive never really thought about it.

As long as its got the same credit limit and APR who cares.

HSBC Business also issue Visa. But then they have just dumped maestro in favour of Visa and yet issue mastercards to bank account customers but Visa to business customers - and as you say, First Direct issue Visa but M&S/GM Card etc are all Mastercard.......

I guess it depends on the lender which card they prefer to use; personally I always preferred the Mastercard / Maestro cards but so long as the card does what it says in the envelope - i'll be reasonably happy :D

  • I've just had a card change - had a Debenham's credit card, and the issuer (Santander - aka Abbey) changed it this week to a Gold Card, out of the blue, and cancelled the old card. Trouble is - in the small print on the back it says that the debt outstanding on the old card will be charged at 28.6% APR (up from 18.6%). That's cheeky.

Paid it off, and got a card from my bank instead (at 12.4%) and Debenhams can stick their card.
