Roxburghe Debt Collectors for PEN

My mate's received the attached letters from these guys regarding a parking enforcement notice. There was no ticket left on the vehicle so these letters were the first he heard of it. He regularly uses the car park and displays a "Pay and Display" ticket on the dash so it looks like it may have been overlooked by whoever issued the parking ticket. I've told him to hold on before he does anything until I get some advice on it - I've looked on Martin's private parking tickets page and it mentions to not pay it if you think it's unfair but if they're threatening court action it's probably passed that point?

  • I see its the "may proceed" game eh!Most of what they say is tosh and Roxburgh are another part of the same firm who sent you the begging letters in the first place. Safe to continue to ignore. Others will also confirm this.

    If they've instigated court action, then it's past that point.

    If they're threatening, that's as much of a concern as me threatening to come round your house and trample on your flowerbeds. I wouldn't worry about it. Tell your flowers not to be too stressed either.

ROXBURGHE IS NOT REGISTERED UNDER THE OFT AS A DEBT COLLECTOR MANY OTHER DEBT COLLECTORS IN THIS COUNTRY, THERY ARE SCAMMERS WHO WRITE LETTERS THREATENING PEOPLE SO CALLED ON G=BEHALF OF APCOA, WHICH IS ANOTHER PRIVATE TICKET COLLECTING COMPANY WHICH IS NOW OUTLAWED, LEGISLATION EITHER IN OR SOON TO BE IN.
    LAW: (Armstrong v. Sheppard and Short Ltd [1959] 2 QB 396)

    You have stated that they would send a debt collector to my address. I refer again to the OFT guidance on this matter, specifically at
    Para: 2.12d (entering a property when not invited),
    Para: 2.12e (failure to leave a property when asked to do so) and
    Para: 2.12f (visiting or threatening to visit without prior permission when the debt is disputed).

8. Furthermore, you are reminded as to the common law provision which allows presumed consent of visiting without prior agreement (Armstrong v. Sheppard and Short Ltd [1959] 2 QB 396). As such, I am notifying you that I do not, and will never ever give consent to you or your agents etc or employees to enter on to my property.

For the avoidance of doubt, I do not wish for any person acting in any manner relating to this debt to visit my property nor do I wish to make any appointments.
    Any person who visits my property in relation to this alleged debt shall be immediately evicted forcibly, using whatever method is reasonable and necessary and available, and I shall have no fear of defending my property in whatever way I see fit. Furthermore, damages shall be sought under the tort of trespass.

I trust the above is perfectly clear and I now expect you to stop all contact with me in any way shape or form.

    Ignore the Roxburghe letters, they and the private parking company have no legal case against your mate - even if he'd parked there overnight across three mother and baby bays.

    It's not a fine, not a valid PCN, just a mickey mouse ticket. Some people here collect these for fun and especially to cost these scumbags some money in sending these threatograms.

    Your mate has done nothing wrong, he has not got a fine, tell him to stop worrying now. It's just like getting some Nigerian Lottery-winning emails , laughing and deleting them as you can see through the pathetic extortion attempt. Roxburghe and the PPC are asking for money that no driver/car owner has any obligation to pay at all.

    Have you seen all the threads like yours on this sub-board? It's a reeeeally common scam.

    You are unusual in never having had a PPC ticket before, at least you are an MSEer and could check this out for your friend. Every original new poster on here is ignoring a PPC ticket except the odd Council PCN case. Click here to see the whole sub-board, almost every thread is about private parking tickets:

    There are hundreds and hundreds of threads, read some now, look at your mate's letter-chain preview on the top thread 'PPC letter/threats, what to expect' (tell him to play snap when the matching standard computer-generated tosh arrives). Our pics on that thread show the exact letters from Roxburghe and their alter-ego, Graham White!

    Tell your mate not to panic when he gets 'Graham White Solicitors' letters x 2 next (and maybe the odd phone call). All of the contact in fact comes from Roxburghe who have no powers and they DO NOT do Court (not ever!).

    Google 'Roxburghe private parking scam' and read any forum advice results you get - you'll soon see a pattern! Read some info on pepipoo forums as well, such as the Watchdog programme from May this year where they tell you what to do with these bogus tickets. Make sure your friend watches this link in full, click through from pepipoo forums (well worth a look at their forum too):

  • Thank you very much 'coupon-mad' for your advice and links, I have watched the Watchdog clip and notice that they refer to England and wondered if the same applies in Scotland?

    My friend recieved a PCN from Central Ticketing and having looked at the advice of the MSE website replied with a letter as suggested. A letter has since been recieved from Roxburghe Debt collectors and a further reply as per MSE was sent. Recently a 'Notice of Intended Legal Action' letter has been recieved from 'Graham White Solicitors' stating that unless the amount due was paid they would be issuing a Small Claim Summons in the Sheriff Court.

    Having replied previously should a reply be sent to the Solicitors or should they just be ignored completely from now on? Is it likely that it will be taken to court and if so what is expected of the RK when they were not the driver? Is there any power to compel the Rk to divulge the driver?

    Any help will be gratefully received. Thanks in advance.

    They won't take you to court. Never have, never will do.

    It's a scam. Ignore them.

    I note the letter says Graham White are solicitors, looks like a valid point to put forward in a complaint to SRA.

    Hi, I have a debt collectors letter from Roxburghe Lts debt collectors for £197! NIce hefty late payment charge on there too now. As per the great advice on the PRivate PArking tickets page, I'm ignoring it, poined ready from the next Graham White letter. I really hate it all but am SO glad I found out raterh than give them any of my money. In fact Elite Parking have already failed to carry out many of the stages of sending out letters at certain stages as they are suposed to do as as a member of the BPA, so that clearly means naff all too.
    I'm ignoring.

    Don't forget that the BPA is just a trade association for the parking industry, nothing more. It's not like a "proper" regulator such as Ofcom or Ofgem.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    Although the parking companies and BPA would like you to think otherwise (hence all the "we comply with BPA" and BPA logo BS you see).
