Canceling my 18 month phone contract

I have been with 02 for about 5 years but im thinking of changing to a different contract this year so i can get a nokia n97. I upgraded my phone on 06/06/08 on a new 18 month contract. This upgrade was done 1 month early via the car phone warehouse.
I went into the carphone warehouse today to enquire about upgrades and possibly canceling the contract and they have said that i can upgrade in November this year, but i cannot cancel my contract untill january because i upgraded my phone early last year!!!
This surely cant be right, can it? I thought that when i upgraded my phone on 06/06/08 I took out a new 18 month contract from that date?
Are they allowed to make me wait 19 months to cancel my contract because i upgraded my phone early?

Yes, you agreed to an 18 month contract, that doesn't mean the old contract terminates when the new contract is taken out, it is simply added after the existing contract...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

The point is very arguable. It looks to me like deceit on the part of the supplier. Well when I upgraded earlier this year, I was a month early and it clearly stated on the paperwork that the new contract started when the old contract ended. So how can that be deceitful? That was with Vodafone...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

How do you assume its deceit on the suppliers part?
Although people here may not neccessarily agree with the retailers in this sort of situation, doesnt mean that we should be advising him to fight it. The idea of these boards are to advise of the consumers legal rights, not the moral rights.
While the OP may not have been told the full facts, it was probably hid among the small print, and while we may not feel it is fair, it would be irresponsible and foolish to suggest he should argue this with the retailer.0 -

its a hard one to argue if they have it in writing. if the customer can argue they never got anything in writing or advised of it then mught be a different issue. One month is hardly the end of the world though is it?0 -
All networks do it, Its standard practice. Some people just dont read the paperwork, DVardy its not deceitfull atall, Just common sence to read the paperwork0

Up to the time I made my comment, no one suggested that it was written in the paperwork. I particularly did not like " Saz, The new contract is added ontop of the old one, You have no leg to stand on. Give up." I think that it is irresponsible to give such advice without an explanation.
