Hi,
4 years ago I became depressed although i didnt know it at the time all i knew that i wasnt well. People around me especially my husband have been fantastic. We had been able to cope with things financially until late last year, when my husband who is self employed stayed at home with me more and more, so I guess you know whats coming next. I have just had a letter handed to me with a bancruptcy order on it in his name, plus I open the mail, and its all debt recover agencies. I have a mortgage and have never missed a payment on this, I did a soa last year so I cancelled everything sky etc. I have all the medical help i need and have just been awarded attendence and carers allowence "how embarrasing am only 42". Just worked out our debt and it adds up to £8.000 my husband doesnt know yet about the letter although he knows about the debt obviously, he wouldnt be in this mess only for me, not that the debt was mine just that he works ever so hard and paid the bill on time until, what felt like the imaginery bus hit me, can anyone offer any advice am so scared.....

First of all dont go blaming yourself.....and also dont go blaming him, whats happened is there and it needs sorting.
Debt is a hard thing to admit to, I hid £64K!!!, but with a strong relatonship it can be tackled.
Bankruptcy is not the end of the world, post on the 'Bankruptcy and Living with it' Board......you'll find advice there from people who know all about it.

Can't offer any advice myself as I'm a newbie who is trying to get her head around things, but if you can post your SOA I know that you'll receive some great advice and support on this forum.

We need to knowexactly what this letter says.

It is very rare for anyone except the HMRC to make any banjrupt as it simply costs too much.

If someone has made your OH bankrupt without his knowledge, it will be possible to overturn this in most instances.

If, as is more likely, someone has written a letter threatening to make your OH bankrupt (often called a Statuatory Demand), then it is far more likely to be an empty threat than a real one.

So can you type out exactly what the letter says, please.

I have been directed to serve with a bankruptcy order dated 12/08 2009 issued under the insolvency act 1986 and issued by 1st credit

i attended your address in order to afffect service of Bankruptcy petition but was unable to meet and i have to inform you that I will attend your address at 9am on september 29th for the purpose of servng you with the bankruptcy petition.

It is my duty to inform you that should you fail to attend the above appointment or any other made in lieu therof an appication will be made to the court for an order of subsitituted service of the said bankruptcy petition by way of advertisement in the daily press or in such a manner as the court may direct.


its even worse typing it then reading it.

It is not embarrasing at all, you have been awarded this help because you need it and are enttled to it

Thanks I know, but I was always a strong person, I thought i had all kinds wrong with me, even today I do, just never thought a mental breakdown could be so devastating and as i said never saw it coming,
and more then anything at the time i had no worries, i could have understood it happening now,
