Advice Please! Where do I stand with Rent Rebate?

If anyone could help me out with some advice regarding this can you please let me know....

I'm privately renting a flat via a letting agents. About 6 months ago we noticed that dampness / a leak (we live on the top floor) was damaging our kitchen ceiling. During an inspection we mentioned it to the letting agent and he told us that its the council that needs to fix it and that its a massive waiting list. This was therefore never recorded in writing.
Just over a month ago during a really wet spell we had another inspection, at which point we mentioned that the ceiling was even worse. This time the letting agent said that he would get in touch with the council for us and get back to us ASAP to give us the details about a repair. We also reported a fault with the washing machine, and the fact that the living room door had come off its hinges. Both of these things were recorded in writing, and it apparently slipped the mind of the guy regarding our ceiling.

We called the letting agents a few days later as we hadnt heard anything, and it was reiterated to us that they would get in touch with the council and get back to us (the letting agents claim they have no recollection of this phonecall but we have a phone record showing we called them.

A week passed, and the hole had got so bad that it was flaking away daily and water was leaking into our kitchen every time it rained (which was all the time). We phone them again, and eventually they gave us an emergency council number to call if it got worse, and if not, the council would be coming out to have a look the following week anyway.

Anyways, it did get worse, and it took 2 attempts for the council to fix the leak in the roof, and it took the letting agents another week or so to do the necesary repair in the flat. Add to this the fact that the reported living room door still isnt fixed, and we were left without a washing machine for a week as the landlord tried to fit a replacement washing machine, which he did incorrectly, and we had to wait on an actual plumber coming out.

During this time me and my partner have had to miss time at work, call on favours from relatives to wait in our flat, have had to make numerous phonecalls to the letting agents, have been unable to use living room door, were unable to wash clothes for a week, and had to use our kitchen at a reduced capacity for 3 weeks due to leaking and the threat of asbestos flaking down onto work surfaces and cooker.

We requested a rent rebate for all of this, and the landlord has come back saying that they are not giving us anything.

Where do we stand? What can we do?

  • bump, any help would be realy appreciated
  • All you can do is take them to small claims court, with proof that a) they acted unreasonably and b) that you suffered quantifiable loss and/or damage.

    I'm not sure how strong your case is reading the above, especially as you didn't report things in writing early on.
