TJ Hughes pricing error

In the latest TJ.Hughes leaflet, on the back page there is a mistake. They are advertising Silentnight Memory Foam Mattress Toppers at £39.99, whereas singles are £59.99 and king size £69.99.
I phoned them to reserve one at that price but they said "oops, there is a mistake, it should have said etc etc".
Nevertheless I would like one at the price advertsied nationally. I must speak to the manager. The manager will ring you back. It's a fault of the printer.
NO NO NO it's not!, it is your fault. You will have given your printing instructions to the printer and you should have done a proof read before giving them the go-ahead to print.
Or you gave the printer the wrong details in the first instance, so again it is your fault.
The jury is out, but will let you know their verdict.

Read up on basic contract law.
Leaflet is an invitation to treat. You make an offer to buy at £39.99. They reject.
Nothing illegal at all. What if the £39 was missing and it was listed at 99p, would you take them to court if they didn't sell?
You can ask, but they don't have to sell.0 -
BUT THEY HAVE!, a call from ***** has said that as a gesture of goodwill and for alerting them to the nationally advertised product, ie leaflets distributed in free papers, stores, national newspapers, they will now put a stop to the sale, but I can have one. Congrats on a lucky bargain. Will make your bed all the more sweeter to sleep in he he Was good of the store to honour your leaflet, would have made it all the better had they honoured everyone who came in with the same leaflet too
Sweet dreams0 -
The aim of my post originally was to tip anyone off that like us had been wondering if this type of thing would be of benefit to them but had been put off by the price. Because my wife is physically disabled, anything I can do to make her comfortable at night is worth a try.
Now, if I wasn't legally entitled to the item at the printed wrong price, then so be it. I'm sure I'm not the only one to learn from that.This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

glad you got a bargain! is it a double then?

well done hope it helps your wife. Is it a double then?0 -
You often find that they will have a disclaimer somewhere in their terms and conditions stating thatthey are not obliged to sell at any published prices that are printed in error.0

However, there is a similar thread on here about Tesco's and their offer of a gents gold ring reduced to £9.50. Many people tried to purchase these at this price and have had their debit/credit cards charged, only to be told that there was a mistake on the price and that they will be getting a refund. I would have thought that once the cash has been debited in this way, then the deal is effectvely done and Tesco's must supply the goods. But it seems that they aren't doing so.0 -
An update:-
The chain store TJ Hughes is selling Silentnight Impress Memory Foam Mattress Toppers priced
Single = £39.99
Double= £59.99
King = £69.99
but their 10 page leaflet distributed in free newspapers and within the store, show on the back page a price error. The single and double prices are in reverse order.
I phoned the store and asked for one at the price advertised and they agreed, so I visited the store today and bought two. I asked what they were going to do about it and it is my understanding that if anyone asks for the item at the price shown on their leaflet, they will honour it. This will only be until the 20th Sept.
So I bought two at the price of £39.99 each.
Tesco Direct sell the identical item at £68.51 and google shows them to be the cheapest.

Don't know if it's still the case but in shops they'd used to have to sell an item at what ever the marked price was - misprice or not. I think that lack of policy continuity crossing over to internet sales has caused a lot of confusion.
It just seems odd that internet sellers have greater protection when if anything I would've thought that it's easier to misprice things shelf stacking in a shop.0
