Dispute with Orange - is this breach of Trading Standards?
Hello, I recently bought a new Samsung phone from Orange. At the time they had an offer of a free HMV £20. voucher with every Samsung phone. I ordered the mobile over the phone and it was really cheap (I was just after something basic). The phone cost £18.99 including £10.00 Airtime and the HMV voucher. I was told by the sales assistant that I would receive a code for this voucher.
The mobile arrived and I registered it. I had originally bought the phone as mine had been left out in the rain and I thought it was broken. It's still working so I thought I may as well keep the new one as a spare. Asked Orange if I could transfer the Airtime over and they told me to ring back once it was applied to the new phone for them to do this. Enquired about the HMV voucher at this time and was told that this would take another 7 days to come through as it was possible that I could return the phone within that time.
A week later, after successfully transferring the Airtime over I rang them to chase the HMV code and was told that I couldn't have it as I had failed to top up with £20.00 worth of Airtime in the first place. I told them that I had not seen this T&C on the website nor had it been mentioned to me in any of the three ensuing conversations I had had with Orange about it. I am now waiting for their Technical people to see what they can do about this. Is this a breach of Trading Standards? I know it's not really a big issue but it's Orange's attitude that has annoyed me. The woman I spoke to on Friday told me that it was "just tough". I spoke to her Supervisor after this. x

Sounds all confusing - assuming you are saying you had a new mobile and sim card.
You also had the old phone and sim card. You trasnferred the airtime from the new phone to your old number.
In that case you have not topped up your new number. No voucher in that case.0 -
I would ask them to explain the deal.
If you top up your phone by £20 then they give you a voucher for £20 why top up with £20?
If it doesn't say on their terms then yes they have not sold the goods as described and thus they owe you a voucher.0 -
The terms of the voucher should have been made clear to you, if you are required to make a £20 top up you should have been told.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

The offer's cached by google on hot deals. The offer there says you have to topup by 20 quid.

Orange have scammed me with this too. It's been over 28 days for me, and the HMV vouchers never materialized. Despite multiple attempts on my part to chase them up. They clearly have no intention of honoring their promise.
It's caused me way too much stress already, I will never again have anything to do with orange.
My question is, I believe they are in breach of contract, how can I get my money back?0
