    just a thought can you prove it? dont you have to prove everything. The boy could just deny it?

  • You don't have to be able to proove anything to make a complaint to the police.

    In order to secure a conviction the CPS would have to proove beyond reasonable doubt that the accused committed the act, but it is for them and the police to secure the evidence not the victim.

    In any event, the child is a witness, there is at least one additional witness (the friend) and potentially others. Witness evidence is evidence, not always as reliable as documentary evidence such as CCTV but perfectly acceptable evidence all the same.

    Update,

    I managed to find out the name of the boy and the school were informed, he was called in and spoken with, denyed it at first

    Was told that if he continued to deny then it would be a passed to the police to deal with and out of schools hands and if found out he was lying then the police would decide what to do with him

    anyway admitted it and had to write an apology note to my daughter, was told repeats of this or his involvement in any form of bullying towards any pupil would result in him being asked to leave the school

    Happy to report to date everything going well and she is settled in well and no bothers.

    A school that deals well with bullies!:T Your daughter's got a good headteacher there. It's nice to hear of a problem being sorted out properly and the aggressor being dealt with instead of the victim made to feel that they are the problem.

    good good. I was on the bus once and some chav 12 year old had the balls (though not dropped) to call me 'names' lol im 23, does he have a death wish.

    Anyway I got up and went towards this dweeb and quickly raised my knee towards this ugly guys head, he flinched.

    I wasnt going to harm the !!!!!, but got pleasure in him being a coward and embarassing him in front of his little chavess gf lol.
