What you have written makes complete sense m_m, the problem is that the others do not understand how IB and IS interrelate.

Can you answer my questions, I can't give you an answer without that information?

I posted this on the Disabilty board because SIL is unable to work througha disability.

If there is another more apropriate board please feel free to move it MM

Sorry, wasn't having a dig at you, it is just very frustrating when people are given bad advice, albeit by well intentioned posters.

Benefits regulars have tried to get this problem addressed since this board started, but the BG will not move the threads and the MSE Team can't be bothered to clarify issues.

I'm sure I can give you an answer if you can answer the questions asked above. ;)

dmg24 I really didn't take your reply as a dig.

Unfortunately I can only give the information that SIL has given us and she can be very stingy with the truth

As far as I can make out , (and please remember this is according to SIL) She gets Incapacity Bemefit of around £80.

She has been off work due to illness since July 2007 .First on Stat sick Pay then on income support (awaiting a decision on Incapacity benefit). Then when Incapacity was awarded she told us that she no longer received Income support.

I did think that sounded odd as she still got Housing benefit but assumed that was because her income was so low (only IB)

Now she has been assessed and told she is entitled to DLA at the lowest care rate.

I had actually surfed the net to see if getting DLA would entitle her to any other financial help but in doing so seemed to get the impression that getting Incapacity benefit didn't mean you couldn't claim income support as well ( in certain circumstances)

SIL has no savings , no dependants and lives alone.

Over the last few years she has put a huge pressure on me, my OH and my MIL(her Mum) financially as we were led to believe she has only IB of £80 ish coming in per week.

If this is true then we of course will continue to try and help. But if she has actually been receiving income support as well as IB that puts a very different slant on things.

She is 38 and short of insisting on seeing her bank statements what else can we do?

OK, we'll assume that she gets the long term IB rate of £89.80.

The govt says that she needs (64.30 + 27.50) = £91.80 to live on, so she is entitled to IS of £2.00 a week. The figure of £91.80 is the single person's amount plus the disability premium.

Although £2.00 does not seem a lot, IS is a 'passport' benefit, and therefore she will not be entitled to full HB, CTB etc (it is likely that she pays a small amount at the moment). She will also get free prescriptions, eye tests etc.

  • Does she definitely get DLA or has she been told she could get it?

She has only just recieved the letter telling her she is entitled to DLA low rate so I suppose officially that will be kicking in in the next week/few weeks or so.

So if she then gets that DlA at £18.65 per week then will she get that on top of her other benefits. I assume that she will as it's not means tested?

If so will that entitle her to any of the Income support Premiums? Ty MM

£91.80 is IB and IS- with disability premium. DLA of £18 whatever is on top of that.

  • Thankyou to all who took the time out to reply , it is very much appreciated.

We as a family want SIL to get everything she is entitled to as she has a genuine medical problem but she is very cagey when it comes to discussing her finances. This would be ok if she wasn't expecting the rest of the family to bail her out financially on a regular basis.

Now we have a better understanding of her income maybe I can persuade OH and MIL that it might be better to help SIL manage her finances better rather than just topping up her income all the time.

    Thanks again MM
