Vendor won't let me view house :(

    Sorry, but you are wrong. You have no entitlement to keep going to see a property just because you are buying it. At the moment, she has no commitment to purchase as contracts have not been exchanged. The vendor could be in totaly chaos getting ready to move and worried that the OP will pull out if she visits and sees the house looking less than perfect. This request to visit and measure up would have been better made after exchange when the buyer is committed and the seller can be more relaxed about there being boxes around and perhaps the place is in a bit of a mess.

    Unfortunately, once my offer had been accepted the vendor took the keys back from the EA :(

    But, I hadn't been interested in measuring up until the vendor changed the fixtures and fitting list. She is taking her curtain poles with her, so I need to measure for replacements. And, due to having an operation, the only weekend I could visit and do this was yesterday

    OK, I didn't put legally entitled, but maybe I should have put morally entitled for those of you that are apt to take things literally ;)

    The OP is not being unreasonable in her requests and will realise that things may be untidy and chaotic whilst the vendor is packing etc....

    The contract you are considering exchanging includes the fixtures and fittings list, doesn't it? So it makes perfect sense to view the fixtures and fittings that are being agreed in the contract. Otherwise you're effecively agreeing to just about anything.

    So, I think you should carry through your threat not to exchange until you've seen the changes.

    The alternative is that you don't view them, and sign the contract based on what the fixtures and fittinge were last time you visited. Then if it turns out the vendor has completely changed them and you don't like it, you sue them for breach of contract.

    I'm sorry this is stressing you but may I suggest you consider the vendors point of view too? If it were me I would start to wonder why on earth my purchaser needed to visit AGAIN. In these days of scams and so on I'd be worrying about "are they looking for an easy break in point, are they now trying to find reasons to reduce their offer now I'm committed to them etc etc. Worry works on all sides. Have you tried having a straight forward conversation yourself directly with the vendor? If you explain as you have in this thread, unless the vendor IS up to something that ought to smooth the wway I'd have thought.
    Also sounds like your solicitor is not doing the best job. I've learnt over many moves it is vital to have EVERYTHING annotated BEFORE exchange of contracts just to be on the safe side. The house I am in now the vendor was sweet as sugar until moving day then Oh my! I won't spook you with ALL the things she did but 10 weeks AFTER I had moved in (!) she asked a neighbour to come round (someone she had been friends with) and remove some light fittings she decided she had forgotten. She got short shrift I'm afraid and has never been back!! Be brave, be calm, DO NOT exchange until all details are agreed by BOTH sides and then just go for it. You'll be fine. Good Luck. x

    Ooh Stonk, just thinking about it makes my head hurt! I think I will request a view, whilst looking at the amended fixtures and fittings list, which hasn't arrived yet.

    I think she has already removed some of the fixtures, according to what the estate agent has told me.

    Hi flossy - oh no, that sounds scary!! I hope you don't have any problems with the vendor now.

    I don't want to call the vendor direct, incase it feels like harrasment.

    I guess I never thought that anyone selling their property would mind if the buyer came to view, it is such a big purchase after all. Maybe she is just as worried as me.

  • Just a thought from the vendor's point of view. If I were your vendor I'd be thinking "The buyer's had a viewing, they've viewed again to show their friend the house, they've viewed again to show their mum the house. Now they want to view the house again - this house is not Kings Cross station ! How many more times will they want to view, how many more of the buyers friends and relatives will be tramping through my house before they sign on the dotted line? "
    I understand your concerns about the fixtures and fittings, as has been stated - you can sue for what's on the list that isn't there when you move in, but how much are you in love with the curtain rails? More than with the house?
    Good luck with your op, but it's not the vendor's fault that you'll be unavailable and can't visit at a mutually agreed time. Could your mum or friend visit and measure up? As for phoning the vendor, if I were your vendor I'd be paying good money to an EA to sort out hiccups with my buyer and wouldn't expect to be contacted direct by you if I'd made my position clear, and if it feels like harassment to you it certainly will feel like it to the vendor.

    Hi Dora. Gosh, I am suprised by some of the views on here, but at least it helps me understand the vendor's position. Thank you.

    I really thought that 3, hopefully 4 visits in 4/5 months would not be excessive! Oh well, as a FTB you live and learn.
