    Well I have received a reply today to my LBA. It is again just the usually letter----they have credited me with £40 to my account but that is it!!
    Does anyone know what I do now
    do I apply now through the Court?

    yes via money claim oneline but I would wait until the deadline that you sent passes. Minus the £40 from the amount you are claiming but when working out the interest, i would knock off the last 2 charges, thus generating more interest for you... am I making any sense? I feel I am waffling...

    Don't worry though, they did the same to me and ended up paying the full amount plus interest plus costs as I stated in my letter

    Thanks for the reply. I posted the letter on 8th May recorded delivery so I would assume they received it the next day---Tuesday 9th.
    When should i apply online then? Does the 14 days mean working days or does it include weekends?
    Getting a bit worried now but I know it will all be worth it:T
    Not sure what you mean about deducting the last charges(crikey i sound thick!!!)

    No you're not thick... I am just tired and not being very clear...

    For example... say they owe you £100 and the charges were on the following dates:

    12th June 2003 £20
    12th July 2003 £20
    12th October 2003 £20
    12th January 2005 £20
    12th February 2006 £20

    They have refunded £40 so you assume that these were for the most recent of the charges applied eg 12th Jan 2005 and 12th Feb 2006 - with me so far? So when you calculate the interest you have lost the 2 charges that will provide you will the least amount of interest and kepy hold of the charges that were way in the past and will have more interest owing. Get it?!

    With regards to 14 days - I count it to be just 14 days not 14 working days... therefore I would file on 23rd May. You can start filling in the claim now and save it and then send it on that date... it's all fairly easy but remember to tick the box about 'reserving the right the claim interest at 8%APR'

    You're not a bother, so don't think that. Someone helped me and now I am passing on my little bit of knowledge. I'm sure you will pass it on to someone after.

    Also - it's nice to get one over on !!!!!! One, albeit on a minor scale compared to their corporate level!
