As you may be aware others ordered lots of them. This is probably what brought it to their attention in the beginning. I do believe though that as a good will gesture they should let it go. Good Luck.

I've studied law at degree level and although you are correct in relation to terms and conditions not being allowed to contravene common law, this was in my opinion a unilateral mistake. Where a contract is void on the grounds of unilateral mistake, the court will refuse specific performance in equity and if necessary, rescind the contract.

I would say that you bought and item online from Tesco which was on offer, and for what you believed was a good price. You completed your purchase and as far as you were concerned the contract had been formed. Tesco have now broken the contract and this has cost you financially, as you will now need to pay an extra £x for the ring. You expect Tesco to fulfill their promise.

Not big words - but the truth!!

I have previously read a thread on MSE about 'loss of bargain'. This was about buying something on the internet and the T&Cs and someone won a court case about it. Sorry to be so vague but think it related to a water butt!

Can anyone else help or guide the OP to the thread?

stebiz - couldnt have put it better! while its permissable for prices to have genuine mistake (which courts take into account) ie 9.99 instead of 99.99 it seems as if this was more like an offer price which would have been covered by -
ensuring special offer prices quoted online are treated as firm prices for orders that are to be delivered in the offer period - how long the offer lasts will be made clear
i havent studied law as you have but this seems clear enough to me. but its very confusing for us mere consumers!!!

stebiz - youre good at explaining - what IS a unilateral mistake?

Let me save you some effort. You have no leg to stand on legally. This happens all the time with internet sales. TS won't be interested in the fact that the woman was 'a bit nasty'. Tesco have broken no law in refusing to supply you with the item at the erroneous price. And what stebiz says about contract law is correct.
