where do i stand with tesco

there was a gents ring(wedding band)on tesco the other night should of been £70 but was down to £9.50 and with h2b and i getting married next yr i brought one and paid
just had a call saying there was a mistake on tesco side and the ring should of been £60.50 so i cant have it at that price but can have it for £60 which i refused:money:
there advistised it for £9.50 when they should of req it by £9.50
so i rang tesco back to speck to a manger as i think they should onr the price
its there fault not mine
am i right???

    Sadly you are wrong. You will note that in their T&C's that the contract is not when money is paid, but on dispatch of the said item. Looks pretty water tight to me. Sorry!!

    Not sure what you mean?? But even if Tesco did use another supplier your contract would be with Tesco. Sorry! It would have been nice in cases such as yours to make a goodwill gesture - but not for those who bought 20!!

    am not sure whether stebiz is right here - there has been a shake up about internet trading (i am assuming you bought over tinternet?) may be worth checking up on this on consumer direct or trading standards website. to me while they dont have to sell to you at any price quoted they DID take your money -to my mind this completes the contract. and terms and conditions cannot contravene the law! be worth investigating further before accepting refund - i assume they have offered refund?

    im going to ring trading standers tomorrow
    the woman just said abit nasty
    they listed wrong and we are not sending out your ring but i can pay the full price if i still want it
    but i rang tesco back to ask to speck to a manger and was told there was no note on there computer to say some one had rang me
    so dont know what the hell is going on now:mad:

    Buying from online supermarkets is not the same as going to a shop and picking out the goods yourself. Prices can vary, so keep track of what you have agreed to pay.
    In many cases the price you pay will be the in-store price on the day that your groceries are put together for delivery, which could be different from the prices listed on the website on the day that you placed your order.
    We recommend that you check the prices when your order is delivered against the guide prices given on the website at the time of ordering. You have a right to cancel if prices on delivery have increased since the time you ordered as this could be considered to be a breach of contract.
    Supermarkets that offer online grocery shopping have agreed to give customers better price information, following action by the OFT.
    Many supermarkets use guide prices on their websites to show the prices of the goods in-store on the day the order is placed. In-store prices may change between the day you order and the day your delivery arrives.
    Some may sell goods at a fixed price except for those sold by weight. Although the price per weight is fixed, weights may not precisely match what you ordered.
    All the supermarkets have agreed with the OFT to make it clearer how their online shopping schemes work, including:
    • upfront information about their pricing policies and how the online shopping process works
    • ensuring special offer prices quoted online are treated as firm prices for orders that are to be delivered in the offer period - how long the offer lasts will be made clear
    • easy access to the terms and conditions.
    this is from consumer direct webpage. as far as i can tell from them and trading standards as you are dealing with british firm your rights are the same as if you went into shop! would manager track you down at home and complain you underpaid at checkout? i would definately take it further hun - at the very least you are owed an apology if not a good will gesture or the goods at price offered and paid for!!!

    I've studied law at degree level and although you are correct in relation to terms and conditions not being allowed to contravene common law, this was in my opinion a unilateral mistake. Where a contract is void on the grounds of unilateral mistake, the court will refuse specific performance in equity and if necessary, rescind the contract.
