Hi,
A year ago I sold my house and had 9k deposited into my bank, later that same day , the bank also deposited 19k into my bank for some reason.
ANyway 6 months later they asked for it back, i didnt send it and after a while i got fed up of it and sent them a cheque for 10k to keep them off my back.
ANyway they never cashed it and I got a letter back with the cheque a month later saying my account is closed and i owe them no money, today i have had a letter saying its going to court, its a claim form and there asking for it back.
does the facgt i have that letter mean i dont have to pay back or not~? im stressed with it all tbh
thanks

So basically you want £19k (or £10k, can't actually tell from your post how much shouldn't be in there) for free?
Its not your money so you are not entitlted to it, simple. You owe them the money.0 -
i thought it was at first as it went in the same day as my house sale, does the letter not help me legally?0

Don't think so. You may get some leway in that they might offer you a plan for the money rather than demand it all back at once though.
Good luck....0 -

If I was to believe your story..........and I don't, I would answer:
That letter is a mistake just as the original transfer. You still owe the money.
Pay it back, or the bank will take you to court. You have no defence.
Hope you had a good time spending the dosh!
(As I said, I don't believe the story in the first place.)0 -
ye i got a car and paid for me driving lessons, things like that, ive no job so what was i supposed to do0

It is actually theft even though i was their error and they would be entitled to bring the police into it and have you charged with theft. I feel for you its their mistake but I think people underestimate the seriousness of what they are doing when they are spending money that isn't theirs and justify it by saying its the banks fault.0

ok fair enough, i just thought when they sent the letter saying my accounts closed that wud be the end of it all.0 -
I'd hardly call this "in your favour". They're basically now suing you for what you stole from them. That's not a favour!Starting Debt: ~£20,000 01/01/2009. DFD: 20/11/2009 :j

19k is alot of money. If i 19k appear in my account and it should be less id wonder what was going on and be on the phone same day.
Simple advice, grow up and pay it back. Simple0 -
bad credit report here you come, its theft and really you should of put it aside. Try do it with inland revenue on over paid tax see what their responses are, same thing really0
