Can someone help me with ebuyer?

Please can someone help that knows about my right etc with ebuyer, bought 32" tv with freeview £269.98 march 2009, august 2th they came and collected it, not repairable they will not replace as the next one they have is £45 difference and we have to pay that if we want that one and so they are refunding the money to us, all well and good but surely they have to replace as 6 months is well within the year warranty/guarantee the lady on the phone says no take the money and go elsewhere:rolleyes:

If they can't replace with identical model, then they'll offer you a refund. They can't swap for something they don't have!0

You can ~request~ repair or replacement, but they are not obliged to replace it with a more expensive model. Have a look at what the Sale of Goods Act says:
