Insurance problems. Help!!!. Advice needed.

I have had my Car stolen on the 1st of August this year. I went through the procedure for reporting the theft to the Police and to my insurance Company (C I S-Co Operative Insurance). All my details were then forwarded to the loss adjuster/Claims investigator (Cunningham Lindsey Manchester) which is standard procedure. I have sent all the details and paperwork they have asked for including Keys,Log book,Mot Cert's, Pics everything i had. I could not send them the Service History pack as it was under the seat in the vehicle at the time of theft. I have also mislaid the Original Receipt and could not supply this Although i have given as many details as i could about the previous owner who i bought the Vehicle from. The previous owner by the way has now moved house and i cannot trace Him. Cunningham and Lindsey have now told me they are applying for a full Dvla Vehicle history check which will hopefully give the original owners address to Verify the original purchase and Supply a copy of the Receipt.

In the next sentance the Lady at Cunningham and Lindsey told me if they could not trace the original owner or get a response from him they would probably reject my claim!!!. Is this possible??? I am at the end of my Teather with this problem. After countless phone calls to the Insurance Company and the Claims Investigator i am still no further forward and feel as though i'm banging my head against a brick wall. Time keeps ticking on and i am stuck without a vehicle, Losing sleep and feeling generally depressed with the whole situation!. And to top it all none of this is my Fault!. Any advice would be very very much appreciated regarding this total mess!

    Very unusual.
    Is there anything in your title to the vehicle which is a little out of the ordinary? For instance, is the vehicle owned by somebody else, was the V5 log all present and correct?

    Hi Mattymoo. There is no problem and there has never been a problem with the log book. All log book details are present and correct.

    The vehicle has been in this Household for around 3 years. It was registered in my partners name first for approx 12 months while she was using it and i was using the company van then she wanted a smaller car and i then swapped the registration doc to my name as i was driving it most of the time but other than that no problems. I really cant understand whats going on. I have supplied everything they asked for like i said except an original purchase receipt and the Service History pack. I think the Original receipt was in the service folder which i have explained. And now all this hassle. Any ideas as i'm totally [EMAIL="P@#*"d"]P@#*"d[/EMAIL] off with all the Hassle now and its really getting me down.
  • If I were you I'd ring up my local council trading standards and have a word with them about it.
    Sounds to me like the Insurance are checking to see if you're defrauding them.

    When my car was stolen I didn't have to produce half the documents you've had to.

    Maybe trading standards can intervene for you and help you to get a pay out as soon as possible by sending the insurance company a letter from them.
    Worth a try.

    I have been in touch with the Ombudsman already as i'm not happy with either C I S or The Loss adjusters. In 6 weeks i have had hardly any Communication except where i have telephoned them. Not even a coursity call letting me where we are with the claim. Its an absolute joke!. Its my time, My phone bill all the while! and all of a sudden when you have a claim it seems you no longer are a customer!, you seem to become a nuisance. I have had the telephone put down on me several times by the claims department. And no i am not being abusive yet! but i do feel like my head is going to split sometimes. What a wast of time!.

    I'll give citezens advice a call tomorrow and see if they can help.

    Just a tip.

    When you think a financial or insurance company is starting giving you the run around, write a letter to their complaints department with the title "Formal Complaint" as soon as they start doing it. (You are not too late now.) Send the letter by recorded delivery to them so there is no argument when you sent it. You can then after 8 weeks of them not doing anything put in a complaint to the financial ombudsman service. Hopefully this will give them a kick up the behind to do something.
    I'm not cynical I'm realistic :p

    Do you have both sets of keys?

    Did the car ever turn up and what sort of car is it?

    Hi. No i did not have both sets of keys. just the one key from when i purchased the car and never had another one cut. This has never been an issue though. And it was a mitsubishi pickup. It has not turned up as of yet.

    The arguement the insurance are putting across is if i ever owned the car or not lol!. Even though i have sent the original log book, Key,2 mot's, Pictures. Receipt for a sports canopy/top i purchased and obviously the fact that the same car has been insured in this house hold for the last 3 years approx. Also my partner could possibly get proof of her insurance on the vehicle when we first bought it.

    Fair enough i do not have the original purchase receipt but the settlement should reflect current market value.Shouldn't it???.

    They could also call the Mitsubishi main dealer up where i had the vehicle serviced.
    I feel at the end of my teather. What next???. I guess more excuses reasons why not to settle. Insurance!, What a total wast of time. They would and probably have got away with Murder.:mad:

    Only having one set of keys and the vehicle not turning up can sometimes ring alarm bells.

    It sounds like there may be a discrepancy over the ownership of the car, it might be worth running your own hpi check (Or similar) to see if it throws up any information that you are not aware of. For instance the previous owner may have had outstanding finance and a finance company may have repossessed it.

    Well i did a Hpi check and all is ok as i expected it to be!.

    I think i may of cracked the problem of funding proof. When i purchased the vehicle i had re-mortaged the house and had a top up. I put some of the top up Money towards the Car at time of purchase. I have been on to the Building Society who are sending me details of my remortage with all the figures of extra Money i borrowed and dates that prove i had the Money available at the time of the vehicle purchase.

    Does anybody know if this will be acceptable???? :confused:

    So far they will have had the Key, The logbook, 2 Mot's, Pics, Receipt for Hard Canopy and now Funding proof at time of purchase. Only things missing are The Purchase Receipt and Service pack which were together in the Car....I know!,,,WHAT AN !!!! :rolleyes:

    That will help, did you withdraw a similar amount of cash from the bank / BS about the same time you bought the car as this would be very good proof.

    Did you buy the car from a newspaper advert or internet advert?
