The selling agent should be making sure there is a HIP!! do a google search for " can I sell a house without a HIP" and you will see lots of information. The government say you cannot sell a home without one0

She goes to see them tomorrow.
What should she ask about the property and lack of HIP ? its a pretty big estate agent got it up.
It is to buy not an auction.
Its recently done up, but I do not think its been on the market that long, since they were humming over her offer and at one point wanted more (it was 2k over the offer price, but they wanted 10k over..) 117 and not the 125 they wanted. (its up for offers over 115)0 -

What can you do if a HIP/EPC isn't provided?
Sellers or their agents have to provide the pack within 14 days of a request from a buyer. A seller can refuse to provide a copy in limited cases. This is usually when a seller believes that the person making the request:- couldn't afford the property
- isn't really interested in buying the property
- isn't a person who the seller would wish to sell the property to (but this doesn't allow them to unlawfully discriminate against someone)

OK full story, not that there is much to it.
Flat on market for sale or rent
recently done up by the looks of it, nothing special but modernised, its about 100 years old
Its in a prime location on the coast for 1st time buyers, and houses do sell pretty quickly along this street
Prices in street range from 90-130k ish
Price recently dropped from 125k to 115k
Estate agent says its now offers over
Mate puts in offer for 117k, they humm over it for a while than accept but won't take it off market. Estate agent suprised they accepted it
Estate agent knows mate has 30k to put down and is a 1st time buyer with mortgage in place by them
Asks for HIP last Tuesday, they say they will send a link ? Nothing recived so yesterday so mate calls up, saying they will come in for it Today as they are in town. They put them on hold and 15 minutes later say "oh we don't have one, the property has been on market for so long it does not need one"
They love the property and are in town so are going to call into the estate agents as they won't move forward with out a HIP, with out good and just reason.
We know its illegal not to have one, but what good reason would they have for not having one, and if they have a reason what evidence should we ask for. If they do not have a reason is it worth going direct to trading standards, or giving them a chance to produce one ?
As my mate does really like the flat etc, and is not willing to walk away just yet. But has now wasted 3 weeks with the estate agents and applied for mortgage etc. and appointed solicitor etc. in last week.0 -
Not having a HIP isn't a disaster it just means that the buyer will haev to apy for the local search and a drainage search (if he or his solicitors really think a drainage search is important).
May be the EA is not telling the truth about how long the place has been on the market - but is it really that important? You can try seeking a reduction equivalent to the cost of the searches. The seller is still legally obliged to supply an EPC - and your life really wouldn't be worth living without seeing one of them - with all the really useful information it contains (???), would it?RICHARD WEBSTER
