Just taken the first step *scared*

Hi all
This is my 1st post on here and would like to tell you a brief story regarding my circumstances.

I have always had small debt problems (never been able to get credit, ccj's etc etc) but in jan 2008 they took a turn for the worse because at the ripe old age of 38 i decided to buy a house with my new girlfriend, to cut a long story very short, the relationship didnt work out and we went our seperate ways, eventually the house was repossessed leaving us with a debt of £44,000+ and other debts on top (council tax etc)

my income is £700 per fortnight, i am living back at my parents and my only asset is my car which i need to complete my 40 mile round trip commute.

I have a new girlfriend now and we have spoke about getting married, but obviously, being a homeowner herself she is worried about my debts affecting her.
today i took the 1st step towards sorting this problem out, i phoned CCCS and have an appointment booked for 24 sept.

Is bankruptcy the most likely outcome, i have been with my new girlfriend 8 months now and so much want to marry her but obviously dont want any of this mess causing her any problems

  • If you go BR and have no joint accounts or debts together then it won't affect her.

    The only thing would be you won't be able to get a mortgage for a while because of the BR.

    Well done on taking your life into your own hands and dealing with it all.

    Anyway....welcome along...good to hear you have CCCS appt & that you want to resolve your situation. Remember CCCS have a debt remedy indicator on their web site...maybe worth seeing what the outcome is . Everyones situation is different & there may be another way so please keep an open mind at this stage.

    Your new GF won`t be affected. BR is a personal financial matter & she would only be implicated if there were any joint accounts .

    Thanks for the words of encouragement, yes is the answer to the "iron maiden" question, i will keep you informed on how its going, i guess i cant really post too much on here until i know more, which will be after my CCCS chat
  • Hi maienfan. You've already taken the biggest, most important step and got that appointment with the proffessionals (spl?).

    I can't really add anything that the others haven't except to say that you have excellent taste in music :D

  • I have been reading up a little on this site and it has come to my attention that "a creditor could make me bankrupt" obviously saving me the best part of £500 in fees.... could someone please elaborate on this for me and advise me on what the first step down this route might be

    The only creditors that would most likely petition for your BR are Amex, Her Maj's tax man and the council for council tax but it is not a matter of course and takes a long while. Some business traders may do so as well. Most creditors just harass you.

  • No i'm not in Scotland, i live in lancashire

    my debts are
    £44k building society (repossession)
    £1000 to local coucil (council tax)

    there are others, but they are the main 2

    i was just trying to avoid the £500 (ish) fees

    Doubt whether you will be able to I am afraid. If you have decided BR is the way to go then stop paying any creditors and use that money for your BR.

    There are a few charities who will help as well, contact your CAB to get help with that.

  • To be honest i really dont mind having to find the money for the fees, but if it was avoidable then obviously i would have preferred that option, as i say on the grander scale i would prefer to pay £500 than stay awake EVERY night worrying
  • Ok tomorrow is D-day so to speak, CCCS are phoning, what should i expect? what should i have close to hand? and does anyone have any advice?
