I've just come back to work today and have a message left for me from a colleague asking me to ring Francis on the above number. Can anybody tell me who it is likely to be. Really not happy about them ringing me in work. Should they ring me back what can I say to them about not being happy with them ringing me in work (have asked them to delete my numbers from their records and only contact me by letter).

Many thanks.

Dunno but not many debt recovery places usually leave a free phone number... (they get charged about 8p per minute when people call them on an 0800 number)

Can you call them back on a phone where you can with hold the number?

There have been loads of comments on this forum that suggest MBNA are one of the nastiest companies to deal with. Hang on in there, it's not personal.

  • Arent MBNA an american company? They usually try the tact that because of this they dont have to comply with U.K. law, which they do. Keep hammering away at them, they usually accept it in the end but before you get there they will try alsorts of tricks, Capital one do it as well.

Write to them and copy to payplan stateing that you have entered a debt management program and all future correspondence should be via payplan in writing only. Tell them if they phone you at home or work or send any further correspondence directly to you that you will consider it "harrassment". In law harrassment of a debtor can null and void the credit agreement. Send it by Special Delivery and get advice on the wording from CAB or Payplan etc. Once they know that you know your rights they "should" back off.

    Edited to add

If you have requested that they delete your number from there system then also reitterate this in your letter. Send a copy addressed to the data controller of MBNA then if they continue to use your data in an unauthorised fashion you can report them to the information commissioner. I have had a complaint dealt with by them and no more unsolicited calls since.
    I have a cunning plan!
Proud to be dealing with my debts.

    Hi,

If they do not remove your number from their database and call you at work again, complain to Trading Standards. That is definitely in breach of Office of Fair Trading guidelines on collecting debt and constitutes harrassment. If enough complaints are filed, they can have their licence revoked.

I had to do this with a well known bank who called me at work and actually left a message for me on my company's medical emergency answerphone!!! Very embarrassing. They took the number off their database and apologised in writing. Trading Standards were great.

    Good luck.
