Returning New Xbox To Argos Issues

Ok, on 20th August otherhalf purchases an xbox 360 for me from Argos, £166 premium version!
My birthdays today and I already had been given an elite from my dad and I obviously dont need 2 xbox's, my dads box is opened
So the xbox from argos is unopened and completely sealed, with receipt mentioning 30 day money back etc, we're now on the 4th september
A friend seems to think we'll have problems taking it back as its electical, taken a look on argos site and it says
"Please note all video games consoles are excluded from the Argos 30 day money back guarantee. Please ensure you read the specification on the box before installation. We also cannot accept back video gaming software under our 30 day money back guarantee if the plastic wrapping has been unsealed – this does not affect your statutory rights"
What are our rights in regards to getting a full refund or can Argos just say its not included in the money back deal
We were planning on going back to the argos store tomorrow, which will be the 16th day since it was purchased
any help would be great, i'll carry on searching for previous answers aswell

If it were faulty you could have redress but there's nothing a retailer has to do if you change your mind (except the 7 day distance selling regs I think, which don't apply to an instore purchase).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As its still in its original sealed wrapping you could try, explain what youve said here maybe it would work. They wouldnt give a refund but they may give you a credit note for something else. If the assistant wont help ask to see the manager.
My phylosophy is dont ask, dont get. If they say no, then youre no worse off are you.

As stated above, you have no rights to a refund just because you have decided you longer want the product.
Its not faulty is it?

If I were you, I would go to the retailer and ask nicely if they could possibly help you out etc, etc.

Have a look at the receipt. There should be mention of an exemption there. Argos works are, I believe, supposed to circle that to show they've told you about this. If it's not circled, I suppose you could say you - or your other half weren't told about this.
But legally, given it was bought in a store, you don't have the right to take it back. Any in-store return policy is a consumer friendly policy done by the store, but not a right. Honestly, I'd be tempted to keep it. You could use it for multiplayer games, and if your 360 red rings - which a heck of a lot of 360s seem to - you can use it while yours is in the shop. I know that my 360 died on its backside many a time. Though some people claim the problems less pronounced these days.0 -

You may well be correct - but there may be some room for manoevre as, although allowing the return of 'perfect' goods is a goodwill gesture by the store, if Argos published policy is a 30 day unconditional money back guarantee provided the item is unopened etc., then surely they can't change their mind after you have bought something with that condition attached?
And the exclusion on the website is a bit ambiguous regarding consoles - telling you to check the details on the box before installing could be construed as implying that you can't return it once you have attempted to get it up and running. If its clearly still in its original unopened packaging then they should be able to accept it back and re-sell it.
I think the OP needs to be careful in their approach to the store and try a bit of sweet reason, rather than getting cross, and they may well find that the store helps them out.ELITE 5:2

I remember one time I bought a nintendo ds from Argos and when I got out of the store I recieved a phone call from b/friend to say he had just won one, so I went back in and tried to return, it was about 5 mins since I bought it, and they refused to take it back beacause they don't refund or exchange unless faultly!!
