  • I would expect that OEMs will be issuing OEM Upgrade Versions as part of the scheme, which;

    a) Is restricted to the machine the OEM supplied, as per any other OEM version.
    b) Probably provided under the agreement that it is a Vista > 7 Upgrade only
    a) Could not physically be used to upgrade from any version of XP

    You're left in the situation that it probably can't do it, and if it could it wouldn't be licenced anyway. Not a good situation.

    OEM versions were not included in the EU/Internet Explorer furore, as the OEM is free to preinstall whatever software (including web browsers) they want to. Now that Microsoft have proposed an acceptable resolution, Retail Upgrade versions will be at POS at some point after launch.
