Bay Park Management - Can I win in court?

Just came back to me with:

    c/o 105 Seven Sisters Road
    London
    N7 7QP

Not sure if that helps you any more?

I've seen this address before - I think it is atached to the old CNJ contracts company and from memory also showed up as the "changing from" address when the new C N J Contracs company "moved" to Calendonian Road.

Maybe that is where they operate and they changed the address when they got the confidentiality order? I dont suppose anyone is local and could check it out?

Update on my "case" I've been speaking to the landowners and they are backing Bay Park unless I have an authorised reason for parking where I did - I dont - it was a mistake and my argument is based on the disproportionate charge and not that I had a right to be there.

I'm considering adding the landowners as a co-defendant in my case but this will cost me another £40, does anyone know what would happen if I did that - would my case be re-heard or would the existing warrant just be transferred to the new company?

    The landowners say:
Yes we still have an agreement with Bay Park Management to operate parking control on our estates where requested.
Yes, the fee (£295) is within the industry guidelines
All signage meets with the Parking Enforcement Code of Practice and has been verified by our legal advisors.

    What to do next?

Looks like an accountants but has their phone number on the front : 0171 263 3295 so that's 020 7263 3295.

Although next door also claims to be 105.

You could try asking the baliff/court what they suggest, afterall they have upheld the claim.

From the GoogleMap you have three companies at that address :

  • Just spoke to Mount Mansions and they are the only office at 105, 7S Rd. She hadnt heard of the Bay Park company directer or "Bay Park" or "C N J Contracts".

020 7263 3295‎ as you say is Bay Parks phone number.

OP, were there signs in the private business park about no parking and the possible fines etc.
    It's someone else's fault.
  • Yep there were signs (that I saw afterwards) but that doesnt mean they can charge what they like. They could put up a sign saying you would get shot if you parked there but that doesnt mean they could legally enforce it.

Fair enough, I agree that a lot of these people are nothing short of legalised robbers. However people need to be careful and check thoroughly for parking signs and when they see them don't ignore them. This debate has been going on for so long now, why don't people simply check. Where I live the signs are 25 ft apart, it is absolutely impossible for a driver not to see them and yes people are clamped every week. The fine however is £75 which I think is reasonable. But WHY do they just blatantly ignore these signs, it's just incomprehensible.

This is not having a pop at you, the signs where you were may have been small or well hidden but there are a lot of people who only have themselves to blame.

Except it's not a "fine", just an unenforceable invoice. And why do you think £75 is "reasonable" .I might as well charge you that amount for reading this.

Unfortunatly it was a fully enforced cash only payment or we take your car.

My small claim court case is based on a reasonable fine being £60 so have sued for the remainder, legal fees are adding up on top of that now tho :(
  • I would advise some caution here, I work with a property company in the Heathrow area and we used to get all sorts of problems with people parking on some of our properties without permission.

I know from experience that the parking code of practice relating to vehicle imobilisation sets advisory charges and from memory £250 - £300 is about right.

May be worth getting hold of a copy before persuing any further and checking.

I also know from experience (my son got clamped, £200 for being there 5 minutes) that if they are SIA registered then they are fully licenced to operate and invariably they will have photographed your car with clamp attached with a sign fully visible in the picture, they use these as evedence in court.

Good luck but be aware of my experiences.

Sorry, my reply was meant for dodger1 who seems to be on the side of the scammers.
