Bay Park Management - Can I win in court?

-
Hi Chris
My experience was that two men working on behalf of Bay Park Management clamped me whilst I was in my car. They turned up in an unmarked tow truck, installed a quick throw on clamp on the back wheel and then a more substantial clamp to the front wheel whilst I was protesting - telling me that they would charge me with assault if I obstructed them in any way - and insisted I pay £295 for release, £145 release charge and £150 for calling out the tow truck. They were fairly intimidating in their conduct. They told me that there was an independent appeals process - this was a lie, in fact the appeals process is a discussion within Bay Park Management. I was sent a letter saying that my appeal was being rejected and if I contacted them again they would be seeking a court order against me for harassment. I am not making this up! I'm taking my chance in the small claims court, but since there is a confidentiality agreement to prevent disclosure of an actual address I am not confident that I can get any CCJ paid.
I'm sure that they will be a very effective deterrent for unauthorised parking, but do consider the odd moment when you have deliveries coming in, friends dropping by, a courtesy car without a permit - they are not reasonable people, and they will seek every opportunity to clamp and then extract the maximum sum possible with no chance of appeal. They have claimed not to be VAT registered and do not have a VAT number on their receipt, yet they have been VAT registered for some time. In the letter sent denying my appeal, they have made several deliberately untrue statements - fortunately I can prove that they are lying. I suggest you consider whether the aggression and bad feeling that this firm generates is better or worse than the unauthorised parking, and whether you are happy to have the odd encounter with them yourself.
Another thing to consider is that these people have secret addresses because of threats and vandalism - your residents association will not enjoy this protection.0 -

What is their 'proper' name??
Is there a limited company number on their docs or are they a sole trader set-up??
What address is on their docs0 -
AFAICR if they are SIA registered [which they have to be by law] then you should be able to enforce any judgements against them.
The clamper that got me was SIA registered. Ive spoken to the SIA they regulate the clampers themselves (ie. the licensed individuals) not the companies that employ them.0 -

BPM is a trading name of CNJ Contracts Ltd (06334388), note that the company "C N J Contracts Ltd" has been dissolved - they have set up again under an imaginatively new name.
Check them out on the companies house website sorry cant post the link.
There latest company has a proposal to be struck off already.
Its annoying because my warrant is "unfulfilled" as the baliffs couldnt get cash from the PO Box address - I would change the address to one registered for CNJ but confident that wont work either - they will know how to deal with baliffs.
Im trying the landoners to help get some leverage as they have been implicated in this by BPM.
FYI the directors name is James Allen I have spoken to him, he is very sure of his position, seemingly quite helpful but in my experience a big fat lier.0 -
Have you tried clamping one of their cars outside their address??0

If the Post Office will not reveal the real address behind the Post Office box then a court order can be obtained to force its revelation. Telephone your local court.0

CNJ CONTRACTS LIMITED
430-432 CALEDONIAN ROAD
LONDON
GREATER LONDON
N7 8TD
Company No. 06334388
Status: Active - Proposal to Strike off
Never filled their accounts and looks like they might have to cease trading soon.
On the PO Box and Post Office front, I've never had them refuse to hand over an address.0 -
Just spoke to the Post Office :
Bay Park Management
PO Box 52668
London
N7 7WX
This PO Box has lapsed and they no longer have any records of it. Any post sent to it should be returned to sender.
And because I never take the first response.
I then tried phoning again and they found the address but said it was a sensitive box that they cannot give out. The guy I spoke to doesn't know how I can get the information from behind a PO Box number, but will get back to me.
Looking at the companys website : https://bay-park.co.uk/aboutus.phpPlease note: Due to the nature of our business, our company has been risk-assessed by the Metropolitan Police service and its Directors made the beneficiaries of a Confidentiality Order by the Secretary of State - under provisions of The Companies (Particulars of Usual Residential Address/ Confidentiality Orders) Regulations 2002 (SI 2002 No. 912).
Whilst our company's Registered Office address complies with Companies House requirements for a Registered Office, it is neither a trading address nor a usual place of business, for security purposes. If you wish to correspond with Bay Park Management, please do so via our correspondence address; PO Box 52668, London, N7 7WX.
At a guess, I expect it needs to be a written request from a court/baliff, might even require to see a copy of the warrant in order to release it.0 -
Just came back to me with:

Not sure if that helps you any more?0
