Return a blackberry...

Hi, just bought a sim free blackberry curve 8900 from amazon for £310, I put my o2 sim in and found that I couldn't connect to the internet.

I googled this and it turns out you have to have a data plan which you can only get on contract. If I'd known this I could have had the phone free on contract, but in any case I don't want a contract and now I have no use for the phone because I only wanted a good phone to go on the internet.

Other phones have always been able to connect to the internet on a payg basis so I can't understand why blackberry force this and make it inaccessible to payg customers... anyway, my question is, is it likely that amazon would take this back and refund at least some of the money paid for it? I've only literally switched it on for a few minutes, I can't afford to lose £310 on something I can't fully use, I don't expect to get the full amount back. I paid by credit card over the internet if that makes a difference, thanks.

I have emailed them but just want some thought/suggestions in the meantime, thanks.

O2 have a pay as you use bolt-on, this means you pay for the data as you use it, but this is still only for contracts.

Hi, amazon won't take it back but that's no surprise really, I knew it was a long shot, anyway just incase anyone else is in the same situation, I found a workaround, you need to change your browser settings (there are 2) to internet explorer and hotspot browser, then connect it wirelessly to something, or use the cds provided to download opera mini browser, that will get you wirelessly online, but to get connected through your mobile network you have to change the apn settings, e.g o2 is user name: payandgo, password: password

This is costly but still cheaper for me than a contract, also you can't send mms, not yet ;)

    P.s thanks for replies!

If as you say you bought this over the internet, and have not had it for more than 7 WORKING days, beginning with the day after you received it, they have no option but to accept it back under Distance Selling Regulations.

See OFTs BUSINESS GUIDE TO DSR
    Pages 17, 18, 20, 25, and 28.

If you are inside the 7 WORKING days, then email Amazon and inform them you are canceling under DSRs and require a refund, if they won't you can also copy the request to your CC company as they are jointly liable under Section 75 of the Consumer Credit Act.

Thanks for that, it'll be handy in the future, I'm happy with the phone now that I managed to get the internet working with no data plan. Still can't understand why blackberry force this as the most basic cheapy phone you can buy can get on the internet hassle free, it even costs more to access with no data plan so I do feel that the choice should be open to the customer (I only use it now and again so a plan is not worth it for me), it seems like an unnecessary restriction.

Still working on getting the mms to work, feeling really close now...

Anyone who is planning on getting one of these with a data plan, orange are the only ones who offer it on PAYG so it would be cheaper to buy with them than get it sim free, phone can be free on contract with a few networks.

P.s now that normal wap is enabled, if I start using it more, I can now get the o2 web bolt on at £7.50 a month (unlimited which means less than 200mb), which means I wouldn't have to switch to orange (their BB dataplan is £5 a month for 50mb)
