The legality of Council Tax late payment fees

To the OP, you have paid the court fees, they are paid off first. What you have outstanding is £74 of Council Tax. It's the common and sensible answer to anyone who thinks that not paying their taxes on time and then trying to avoid the court costs that were correctly raised against you.
To the poster who omplained that the council did not award an spd, when it had reason to doubt occupation then I would point you to the 'Discounts' entry in the Council Tax (Administration & Enforcement) Regulations 1992. If there are other names on the voters roll and evidence of their status cannot be provided then it is reasonable to assume that a discount should not be awarded.it's not the council's fault your band is wrong, blame the Valuation Office !!!!! :rolleyes:0 -

Are you able to point out the relevant section of Admin & Enforcement regs 1992 to back up what you have said above with regards to voters roll and status.
If you are correct, then it means the council is inconsistent cos i know tons of people with multiple names on the roll, still get Sole discount and have never been asked to provide jack sh*t proof.
This is why this lady feels she is being picked on. A dangerous precedence is being set0 -
The regs state that the local authority take reasonable steps to ensure that the discount they are giving is correct - see regulation 14 onwards. The regs don't give specific cases but the authority has a duty of care to the tax payer to ensure discounts and exemptions are awarded correctly.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0

With all due respect, the only people who think that the council act like bullies are the people who being chased for not paying/paying late/ etc their council tax.
I know there are genuine cases of hardship/disputes etc. but if you paid on time like the rest of us there would be no need for court cases, reminders etc and all our council taxes might be a bit cheaper.
Why is it always somebody elses fault.
Because council tax in general is an absolute rip off?
It always surprises me how people seem genuinely pleased to hand over their hard earned money to corrupt establishments who are eager to p*ss it up the wall.0 -
I have two minds about this
If you set up direct debt assuming you have funds there shouldn't be a problem with getting fined as you pay on time so no fine unless a mistake is made.
Problem is if you don't have the money and genuinely struggle, how can a fine on top of what you owe make you pay any quicker?0 -

Have you worked for a local authority before? do you know the conditions they work under? Do you know how little money they get? and how much they need?
Perhaps until you can answer "yes" to the above you'd be better off not making statements like you have.
There are countless poster on here more intelligent than you and if what you say regarding council tax was true then it would have been mentioned before now.
As someone once said "Better to remain silent and be thought a fool than to speak out and remove all doubt."

Councils are nothing more than undemocratic institutions with communist agendas. They are often riddled with Common Purpose graduates ( stopcp.com ) who are slowly destroying this country from within.
They are more interested in !!!!ing away money funding diversity and equality projects that >75% of people don't want. They put up red tape and create complexity where none needs exist.
I don't pay council tax on moral grounds, I'm glad to see at least one poster here also has some dignity and common sense. Obviously that's not you. :money:Disclaimer: The post above may contain traces of quotations of nutters. Ingredients: Nutter free. Factory: Cannot be guaranteed nutter free.0 -
