Thanks Timmy, i havnt sent the email to the seller yet, so maybe i will change it slightly.
He had boxed it all up as if it was new, but i did notice that it wasnt sealed properly, just with a bit of cellotape.
I will let you know how it all works out

Hi,
I've come across a bit of a problem with the mobile phone i recently won (ID ************).
It was listed, described & sold to me as a brand new handset. I placed my bid on the basis that it was a new phone.
The problem is - there are pictures stored on the phone which I have not taken, so I can only assume they were taken before I received it, which means it couldnt possibly have been a new phone when you listed it for auction.
Also, there are a couple of rude clips/videos stored on the phone which I have definitely not taken/downloaded. So thank goodness i had not given the phone to a child.
Would you be willing to offer a partial refund, as I have already mentioned, I would not have bid as much if i knew that the phone was used.
I hope this doesnt come across as rude, i havnt been in this situation before & just thought that i would have a chat to you first, as ebay does encourage buyers and sellers to sort things out between themselves.

Below is the reply i have just got from the seller (i know, he didnt exactly hurry witht he response did he!!)
Its a load of rubbish, the pics were obviously of him and his wife and their friends. The pics were also taken over a few days.
How should i respond to this?
" I do apoligise the phone was new as my mother bought it for me for a present the only thing that could have happened is my sons may have been playing around with it and i did not know which i will find out when they get home,as for a refund i think for what it is it was cheap anyway but please let me know if you dissagree.

You wanna ask why is son was getting up to rudies on his fathers phone.

I'd still say that I want a part refund. If he won't agree then go straight for a paypal charge back for goods not as described. Or if you really like the fone then you have to decide whether to forget the dispute and keep it anyway. I'd certainly be thinking about leaving a neg, something like "Fone desc as new,contained sexual pics,seller would not refund when asked" or somethiing like that.
