I just need a bit of advice, i dont know whether to leave a neutral or a negative....
I bought a 'new' phone...as u can see here, it is def listed as new...

anyways, all was fine, until i noticed a bit of crackling on the line when i made my first phone call...thought nothing of it, and now, that seems fine.
The problem came when...........i was going through some pics i had taken when i came across one i had definately not taken....a bloke sitting on his sofa :rolleyes: so i kept looking...........more of him, then his wife, then his friends, his dog........... then i came across 2 'videos' of female naked boobs bouncing away :eek: :rolleyes:, being squeezed....yeah u get the picture!!
Now, as this was listed as new, i was pretty pi**ed off!! But then i thought what if i had given this phone to a child?? My friends children had been looking at the pics earlier, i would have been horrified if they had come across them!!!
I did pay more to buy a 'new' phone rather than a used one.

The crackling on the line isnt a major issue, i can cope with that as it comes and goes.
But what do i do.........should i email him first? Should i give a negative or a neutral??

If you're not happy with the phone now, mail the seller and ask for a full refund, because the phone is obviously not new.
If you are happy with the phone but want to vent about the pics, mail the seller and see what they have to say about it.
You might get abuse back, you could be offered a partial refund or you could be ignored, but you won't know until you mail the seller to let them know you are not happy.
Once you have contacted the seller and seen what they have to say, only then would I leave feedback.Tank fly boss walk jam nitty gritty...0 -

Contact the seller first and explain the situation, politely of course. This gives the seller the opportunity to respond and make amends.0 -
Forgot to mention, make it clear to the seller than not only are you unhappy about the pics, you are also unhappy about bidding such an amount on an item which was listed as NEW when it isn't, so if you are happy with what you have, ask for a partial refund.Tank fly boss walk jam nitty gritty...0

Use your original post to explain the situation.
As it is not as described in the listings then you are entitled to a full refund. If you used Paypal to pay for it then you are in a strong position.0 -
I's say something like :
Hi,
I've come across a problem with the phone. It was listed, described and sold to me as a brand new handset. I placed my bid on the fact that it was a new phone, if I had known it wasn't a new phone, I wouldn't have bid as much, and probably wouldn't actually have bid at all.
The problem is, there are pics stored on the phone which I have not taken, so I can only assume they were taken before I received it, which means it couldn't possibly have been a new phone when you listed it for auction.
Also, there are a couple of rude videos stored on the phone which I have definitely not taken.
(Some ideas to add to the end)
I would like a full refund for the phone as it is not new and was mis-described.
OR
Would you be willing to offer a partial refund, as like I have already mentioned, I would never have bid so much on the phone if I knew it was second hand.
OR
Understandably I am not very happy about this so, what can you propose to do? (See what idea seller comes up with)

If it were me I wouldn't start asking for refunds or discounts yet as for all you know he believed the phone to be new and may think you're trying it on. If this is the case he may become very defensive and arguementative. Of course this shouldn't be your problem though.
I would contact him and explain the problem and point out that ebay encourage buyers and sellers to try and sort out any problems between themselves before taking further action. Tell him you've never been in this kind of situation and you wanted to know what he thought about the situation before you start going through ebay/paypal/feedback procedures. Now with any luck he'll come to you with an offer as if he is a regular seller he'll want to avoid that kind of hassle at almost any cost!0
