Problem with 3

Basically my dad signed up for an 18month contract with 3 since his contract with Orange was almost up. He went into the store and signed all the paperwork but they needed bank details etc, so he said he would return the next day with the details to finish the deal. That evening he discussed with me that he went to 3 and I told him my reservations about them as well did other people.
So the next day instead of bringing them the paperwork they needed, he phoned the store and cancelled over the phone. Done right?

Well, a few days ago to our amazement we recieved a phonebill off them for £35. Even though we don't have a phone or a sim card. It seems the lady on the phone didnt cancel it after all. He went into the store today to complain and everyone, even the manager said its an 18 month contract and he has to pay it.

So where do we go from here? 3 refuse to cancel it and expect payment on the first bill. I could understand if we had been using it. But we have never had a phone nor have we had a sim card, for all my dad knew the account was cancelled.

Any ideas?

    So he physically signed a contract (as opposed to a verbal agreement) and now wants cancel it because of hearsay from people that applies to every network?

    Why doesn't he pick up the phone and SIM and actually try things himself?

    You want the honest answer? He lost his job and could no longer afford it. I wanted to spare every detail. And yes, he did loose his job the next day after signing. Just in case you question that also.

    Then why make up a load of lies? It would just mean people give incorrect information to you.

    As you probably know, there is no cooling off period for retail sales so unless you can get through to the human side of the store manager you have no chance sorry.

    Does anyone know of Three allow transferring a contract to another person?
  • So to summarise. Even though 3 made the error and "forgot" to cancel his contract. He now has to pay for 18 months?
    I shall try to get hold of them myself too but they are such amateurs. Their website doesn't list an up to date contact number for the store he bought it from.

    Sorry to have made that initial story, I guess a lesson well learned, be honest.

    But he has no right whatsoever to cancel to start with - and they wouldn't do it over the phone at store level anyway, so it isn't an 'error' on their part. If it is a half decent handset he could always sell that and use the proceeds towards paying off the contract.

    If he didnt give his bank details and didnt recieve the pone and sim then no contract was formed. They wouldnt have processed it without all the details
