Has your bank (esp Lloyds) ignored your hardship claim?

We have being trying to get bank charges back since beginning of 2007! We do qualify as the “financial hardship” - but the bank does not feel so. They have fobbed us of with the usual letters initially then we were told to wait to hear the outcome of the court case, then we filled in the form with our in and outs on the finance, they said they did not have it on the phone, another call was quoting from it, another phone call was extremely upsetting as the woman was extremely nasty and going through our bank statement demanding what was what – I felt less than 1” high after that, another phone call was a very nice and polite lady from Far East descent and I knew I would not get far so left it. Meanwhile they have taken away the facility of a cheque book and cheque card garantee, saying they do not use this in banking anymore after letters and phone calls asking about this. We are only just making our living costs and struggling to pay electric let alone food and heating, and still getting bank charges, we cannot get out of this loop, but not for trying. They made our OD a decreasing bankloan ( with interest). I have been so weighed down with all of this that i am not able to think straight anymore.
Why is the law alowing the banks to continue to use us to gain more money when we have to wait and see if we are going to get any back, banks are causing so much misery, not just for me but for thousands of others with this bank charges and their greed causing this credit crunch - so many people becoming unemployed etc, etc, etc because of it and they have got away with it taking handouts from the government who said they were supposed to help us (I do not think so) and we are going to pay for it with higher taxes and a higher cost of living, which will but more people on the poverty line. What has happened to this country!

Half the waiting about seems to be waiting to get an IE form from the bank.
The CFS (common financial statement) is pretty much the industry standard and is accepted by majority of banks and creditors. You can download it in excel format from [....] , complete it and send the bank the final page with arrears evidences and details of your situation, and how the charges are affecting you, by registered mail.
I have also applied under the hardship scheme and have been refused by Lloyds, I am on Disability living Allowance and Mobility Allowance.
Please excuse my ignorance, but can someone tell me what all the dreaded TLAs are? Three Letter Abbreviations I refer to! I have no idea what the above post means, I'm sure the posters are doing so with the best possible intentions,but please desist, normal everyday folk are ignorant of these TLAs!! Thank you.:o

My husband lost his job last year, and after a few months of struggling on my salary (not actually enough to cover the bills) we heard about this hardship option so we filled in the details, sent in copies of statements etc,. to show how he had no income and could he please have his money back.
We got a standard complaints reply saying it had been sent to another dept and we'd hear back in four weeks. We didn't.
We sent a follow up letter.
We got a reply saying something about getting back to us in four weeks.
They haven't and this was months ago.
Since all this has been going on, my husband has found another job. Does this mean we can no longer pursue? Seems like an underhanded delaying strategy by Lloyd's, if that is the case.
What really riled my was the inability to talk to anyone in the right department either - everything had to be done by post.0 -

Alliance & Leicester are also pulling the same stunt... I wrote to them a second time and then rang them and they acknowledged they had reieved the letter but stated they don't send follow up letters and they won't budge!.. I told the guy that it was disgusting that they won't even have the common courtesy to tell you they won't do anything , just leave you in limbo??!?!? I am extremely desperate now to the point I am considering taking a couple of days off to just hammer at them on the phone until I get a positive result. They can't play with peoples lives like this, everybody's situation is different and we understand this route can only be pursued in extreme circumstances- well I think being evicted with your child is an extreme circumstance!!!

I also applied to HSBC for Hardship funding but they wrote back to me and told me that there is nothing they can do until it is sorted out with the House of Lords, but, at the bottom of the letter they told me that if I was in Hardship I shoudl contact them and they can try and sort something out, meaning another loan or something like that to make more money out of me and get me in more debt?? what is wrong with them.0

My charges claim went in the week before all this mess was put on hold, so i have been waiting since July 7th 2007. Fair enough, the banks have put a hold on claims until after the test case, but why in gods name, are they still allowed to continually charge us at the same rate? We still have to wait, so why shouldn't they? The most ludicrous part of all this tho, is the fact the banks can even challenge through the courts or anywhere else. Surely, the fact they had already paid out millions in refunds prior to the re-claims being put on hold, spells GUILTY AS SIN anyway.
Furthermore, the OFT CAN, once the constitutional court formerly the HOL have made their decision known, take out an injunction against the charges should they so wish to until the second part of the litigation is concluded. At the moment, the terms themselves are not yet legally unfair but their assessment is under consideration.0 -
hi i started my claim with Lloyds back in january and got the same response wait till end of test case. we had to leave our home due to me being made redundant and in large arrears with rent council tax water and gas when i mentioned it to Lloyds their responce was "sorry to hear that but we can not look into your claim till after the test case" now if that aint abusing the waiver please what is0

I posted in another thread a few weeks back regarding my confusing letter, and never really got a good reply. Maybe im stupid!!
After reading in one of your emails a month or so back, i thought i would pursue the financial hardship route for claiming my bank charges back.
I had put in a standard claim sometime last year, when i was currently working. I received a letter acknowledging the request and i would have to wait until the rest case is settled.
Fast forward to end of may this year, and i lose my job, like many people. So, to keep 'some' money coming in, i register for jobseekers allowance and housing benefit. To me, this is financial hardship!
So i send in another letter, to my bank, using a template from your site, claiming hardship etc.
I received the following letter (attached to this email). Firstly, page 1 completely confused me, and the rest just missed the point. Basically, from what i could tell, they are just making me wait till the test case is finished.
Im banking with HSBC, and the charges would greatly help right now!!0 -
Adam, it;s not financial hardship unless you are incurring charges since you were made redundant and have priority debt arrears(mortgage/rent, council tax, utilities). It would be usual of the bank to consider a refund of charges since you were made unemployed.
I claim JSA and LHA for a period when I didn;t work for the bank but didn't incur charges so it is not as simple as to say that being on benefits means you are in financial hardship(but it is tough to be honest).0
