  • A good few years back two children were kicking a football around and it hit my car and snapped the wing mirror off. They were seen doing this and after speaking to their parents they agreed to pay for the damage. However when I called around a few days later to tell them how much it was going to cost each parent was blaming the other child for kicking the ball that did the actual damage and refused to pay. CAB told me there was nothing I could do about it and that it was up to the parents if they wanted to make a goodwill gesture.

    So let me ask what would you expect if if some other child in the neighbourhood caused damage to your car or property would you expect them or their parents to pay up?

    Your situation is different to OP's because you cannot establish who actually caused the damage and therefore who to take action against. AS CAB have said, in that situation, all you can do is rely on goodwill.

    Proving any parental negligence over a child falling off a bike will take some doing! But good luck to anyone trying!
  • As it's a neighbour i would pay up to save the aggro, find out how much it will cost first because it might not even be worth claiming on insurance in the long run.

    The child didn't just fall off the bike though, she caused damage in doing so.

    Are you suggesting it was criminal damage?

    It was just the consequence of the accident.

    I almost agreed here. However the "just" implies there is no course of redress.
