    Send a letter to Swintons (By recorded delivery) and advise them that the vehicle is not secure and there is also the possibility the council will remove it as an abandoned vehicle. State that in the event of further damage / loss / costs you will hold them responsible.

    It would be worth speaking to your local council and advising them the vehicle is not abandoned (Take a note of the persons name / time of the call preferrably use your mobile so there is a record of the call). The council can remove vehicles they class as being abandoned and in some circumstances (Your car would fit these) they can remove it without notice or with 24 hours notice

    Heard from Swintons today they are going to pay up on the car yayyyyyy they are coming out next week to inspect it

    Out of interest Debjk is it Swintons or the Insurer who are paying the claim?

    not sure I only got the message on a text from my other half he is at work and took the call there will ask him later.

    I suspect as its a low value claim that Swintons themselves will pay the claim rather than the Insurer as its clearly not covered by their policy and its not really their fault you have bought their policy its more Swintons for not communicating the exclusion.

    The great thing about Swintons paying for it is that it is likely it will not reduce your no claims bonus! You will still need to declare the claim to future Insurers but not losing your no claims bonus will cushion the increase in premium.

    I assume Swintons will deduct an amount equal to the amount you would have paid as an excess if it had been covered by the policy. It could be worth a bit of negoiation here as the matter has caused you inconvenience. If they write the excess of (Probably) £100 off this would be an amazing result, realistically them allowing £25 to £50 for the hassle would also be a good result.

    I'm glad you got the result you wanted, no doubt the rest of the MSErs will also be pleased as it did not seem fair the major exclusion you had on your policy that appeared to not be communicated to you properly so that you could make an informed decision. It will be interesting to look at a quote for TPF&T from Markstudy from Swintons in a few weeks time to see if they have started pointing out the exclusion in very big print.

    When you buy Insurance at renewal, let us know on MSE and we can let you know if the Insurer is any good and have a look at the cover for you
