    Its an interesting case Raskazz, obviously I doubt there is any come back on the Insurers as they have supplied a product and the product does what it says eg Third Party Fire and Theft but with no Arson cover.

    Its such a big exclusion that you would have thought the onus is on the broker to make it very clear to the client they do not have arson cover. It's such a big exclusion if it I designed a website that had this cover on it I would have a box that comes up to alert that there is no arson cover and for the client to have to click to acknowledge it.

    How Swintons have alerted the client to it (Or not) are not very clear but it would be interesting to see the FSA's view on it (Assuming it was not spelled out clearly to the OP)
  • I thought this was pretty much industry wide? The fire part of a TPF&T policy covered your car catching fire, but arson is classed as vandalism and therefore not covered unless you're fully comp.

    Arson has its own definition which is entirely seperate from arson in the world of Insurance (And I believe the law)

    Exclusion of arson is definitely not a common exclusion in the market for private motor insurance.

    For example: No reference to exclusion of arson or fire due to vandalism or malicious damage in any of these policy wordings:

    Thanks Raskazz - I see we're thinking along the same lines in terms of Quinn.

    This thread has really annoyed me and I'm sure if Pedro had found it he'd be using a Markerstudy policy to wipe his backside by now :eek:

    I did some more Googling and found out that the following offering is also underwritten by Markerstudy.

    The Keyfacts document is dated October 2007 so it is rather strange that this issue has not come to light before.

    In an attempt to push this thread up the google rankings -
    Markerstudy TPFT insurance does not cover you for arson.
    Arson exclusion by Markerstudy.
    Fire excluded under TPFT cover by Markerstudy.

    debjk - please don't let this slip. Get in touch with the FOS and speak to their staff. Where there are any shades of grey in a dispute they will bend over backwards to support the consumer.

    Will do, going to get partner to phone swintons tomorrow and see what they have to say. so far I have paid them the deposit and 2 monthly payments comes to over £300 what would happen if they agreed we were mis-sold would we get our premiums back? At least that would go some way to buying another car.

    Quinn Group is based in Ireland.

    My apologies, you're talking about the Quinn Group. Indeed, the head office is in Cavan, Ireland.

    Spoke to swintons who have said this is an industry wide exclusion :rolleyes: after a bit of argueing the man on the phone said he would phone Markerstudy and some other insurers to see if this is right and he would get back to us, no call back so will try again tomorrow.
