What's the Bank's Game?

I sent a template letter off to HSBC to try to claim charges from the Jan 2000 - July 2001 period. It says on this website that it might be possible to claim from Jan 2000 onwards as it was not until 2006 that people began reclaiming, so it's in the six year period.

The letter gives them 40 days, but they sent something back to me in less than a week, but it contained NO letter, just statements from May 2001 -August 2001. It was almost as if they'd bunged them in an envelope and sent no accompanying letter to explain why they were incomplete, so that it would delay me from reclaiming. It almost seemed personal.

It makes me wonder whether the bank is up to something. Are they trying to buy time hoping that by October the fairness decision will be in their favour, and thus by delaying people like me who might be able to claim hardship before October, they might by the time the decision is made be able to turn me down?

    Just to make you aware, the FSA Waiver on bank charges states they will only look at charges July 2001 to present.
    The issue of claiming further back than this point is about UTCCR 1999 and the issue of payback and how long is for the direction of the National Courts to decide.

    So, if I send off to reclaim July 2001 onwards and am fortunate enough to receive a payout, will that be prejudicial if I then find later that I can reclaim money from Jan 2000 up to July 2001?

    It would be up to further litigation how far you will be able to reclaim but it should not prejudice you ability to claim further back should that time period be longer than the Limitations Act.
