  • If you're willing and able to pay rent on two places at once, you can live where you like but you'll still be responsible for looking after the place until your tenancy ends.

    This seems a bit rash to me, but each to his own
  • You're either responsible for the garden or you're not.

    If you are then they should leave you to it. If they want the sort of plants that need special care to encourage them to grow again next year, then they should put them in their own garden.

    If you're not then they should do all the maintenance and have an agreement with you about how often they come round, and give you 24-hours notice each time.

    Of course, what a fair and reasonable person would ask themself is "what would a fair and reasonable person do in such circumstances?" In your position, I'd let the LL round to take care of the wisteria if they wanted to. Obviously the wisteria is going to be around for an awful lot longer than the tenant will be.

    If you take that one isolated thing as the whole point then you're right.

    Sadly that isn't the whole point of the OP's post.

    Many thanks. I really don't want to pay out two sets of rents until my tenancy ends but the LL is now becoming quite intrusive and I actually feel really uncomfortable using the garden (or at least sitting in it). The only reference to the garden in the contract states "To keep the windows in the Premises clean and the garden thereof (if any) properly tended." This I most certainly have done but in fact I realise I have only been in the property ten weeks not even three months yet. I am actually becoming quite neurotic in searching for weeds or any piece of hedge growing out of shape! Actually, although I read the contract thoroughly before signing, it has only just occurred to me (numbskull) that there is not one section stating any rights of the tenant only those rights of the landlord. Is that unusual?

    i'd go thro the agent and send a very polite letter stating that as you are renting the property you expect to have quiet enjoyment of it and unless it is an emergency or maintenance requested by you as the tenant, you will not be requiring the landlord to come round and do gardening.

    if they get p!ssy tell them that if they wanted control of the gardening they should have set the contract up with the services of a gardener included.

    also make sure the gate is locked!

    Do what you've been told to do above. This is bordering on harassment.
  • When a tenancy agreement is signed you are supposed to have a copy of tenants and LL rights and also a copy of LL duties. A LL has to give 24hrs notice to enter your property but any other issues such as yours should be written in the conditions of tenancy, I would agree with the other memebers and tell them to stop harrassing you and also report it to the agents as they also have obligations.

    Without wanting to start another off-topic debate - even with 24 hours notice, the landlord cannot enter without the tenant's permission, regardless of what the contract said.
  • They want to pop round and cut back a wisteria not snoop around the OP's home. I might be being obtuse here but I don't really see what the problem is. OP doesn't even have to be in when it's being done

    Thankyou, yes I will contact the EA and have a quiet word. It is not just the wisteria (although there is actually hardly anything of it). I was initially told that the owner whose father the property originally belonged to would have the personal alarm/fire/burglar disconnected but the first time I boiled a kettle the alarm went off and the owner came rushing round to see what was wrong. The same thing happened another time and this time a voice came over the speaker asking me what was wrong and then a third time. I have requested the service be disconnected (which it was supposed to have been at the start of the tenancy) but nothing has been done and on the instructions of the installers I have had to remove the battery from the fire alarm. Two weeks in to the tenancy the owner called me over the fence and asked if she could come round to cut one of the shrubs down. I did refuse saying I would be doing this myself and did. Four weeks on I was called over the fence and advised they would be making a new wooden section to replace the one there already (nothing wrong with it).and would come round to fit. Last week the two LLs and partner called me over the fence saying that one of them would be round to cut the wisteria down. I said if that is what they wanted me to do I would do it but they were insistent that they would be sending the brother round to do the work and presumed the gates would of course be open. They then queried gaining access to the garage but advised they had a key anyway. I am not trying to make a huge deal out of these events but after ten weeks I am beginning to feel under siege!

    I do have a copy of the tenancy agreement but it does not contain any clauses mentioning any rights of the tenant.

    I will take all advice given to see if I can resolve the above.
  • The tenant should only refuse if it is not covenient, the LL is the actual owner and has a right to inspect the property to ensure that the tenant is honouring their obligations as to condition. They are not allowed to harrass their tenant or enter uninvited.
