Sorry if I waffled too much.
Yes we filled in the I&E form and then rang them.HSBC have refused to look at us being in hardship telling us we do not qualify (please see above the reasons why we think we are in hardship) and have told us to wait for the ruling. DH asked for a letter showing the criteria needed to be met and also the reason why they disagree - they have refused to do either, so the question is ...... What do I do now as they won't do anything other than tell us to wait, can I appeal this?
I also want to point out that the man on the phone refused all requests as soon as we turned down their debt management plan of ten years!!!!

If they haven't or if you ring them again then ask them for a final response so you can take it to the Ombudsman, if they refuse post up here and I will tell you what to do.0 -

Hi, please help a newbie to this board
I recently sent the first letter to HSBC to reclaim my DH's charges.
They have replied with the bog standard letter saying that the charges are on hold etc so DH rang them to go down the hardship route on the basis we have a court date for none payment of council tax and also our BT line has been terminated (although that is a whole other story) and also as his charges are more than £500 per year.
They have told him that he has to fill in an income and expenditure form and then call them back to discuss - and then they will pass it to our local branch who will arrange to see us. This is the bit I don't understand? Is this correct? I am a bit dubious as last time we tried to discuss our finances in the branch we were told quite rudely 'that we had to manage our money better' by a girl who couldn't have been more than 19/20 as well all know this is easier said than done.
So my question is really 'what do i do now?'

Good afternoon and please help if possible.
My DH has just contacted HSBC to go down the financial hardship route and the man on the phone has told him outright that we do not qualify as the loans we have, caused ourselves to go into financial hardship although we have had to get loans just to pay the bills etc.
He did offer DH a management loan that he refused point blank at which point the man on the phone became quite rude and basically told him that he was no longer willing to help. DH explained that the loans were to pay bills etc and that we have a court date for un payed council tax etc and also we have more than £500 of charges per year (more like £500 every 4/5 months) at which point the man said that that was not a reason and he had never heard such rubbish and didn't know who had been feeding us such lines! DH asked for a copy of the criteria list and also a letter confirming that they disagree with the hardship and was told no and this was now the end of the conversation and wait until the ruling, he then hung up.
So my question this time is: What do I do now? So upset to be spoken to like that.

Soooooooooooooo glad you refused the Management Loan (biggest con in history IMO) , I;d certainly complain to the FSA about HSBC's actions.
If they won;t give you a final response, and it sounds like you have already tried, just take it to the Ombudsman.
I;d also leave the bank and open a new basic account elsewhere.
Leave the Overdraft where it is.
Have you spoken to CCCS (consumer credit counselling service) about a debt management plan ?LegalBeagles0 -

I have emailed HSBC again so will see what happens......
With regards to CCCS - no I haven't and to be truley honest up until this month me and DH were struggling however there is a slight silver lining as DD2 is just about to finish full time nursery (costing £700 per month) and also my mortgage is about to be dropped by £150 so in the future we should be ok. However the debts we do have and they are not that big would be cleared by the amount of charges due back (with or without interest) so really what I should say is if the bank paid back what was due it would solve our money issues.
Also just to say, we don't have an overdraft on the HSBC (they took it away from us when we cleared it a year ago) and usually they allow us to go overdrawn - hence the bank charges but as DH called them yesterday they have now stopped allowing us this and as such a DD has just bounced they paid it first thing and then recalled it several hours later (after DH's conversation with them)0 -
Okay I see. How much do you take home if DD2 is costing £700 a month in nursery fees? If your debts arent that big concentrate on the priority ones - council tax / utilities etc and put the creditors second.
What are the loans? Do you have equity in your property ?
Without seeing your IE sheet it is hard to tell but I think from what you have said so far that you might not be eligible for a hardship refund under the waiver.LegalBeagles0
