What do I do now - HSBC UPDATE

Hi, please help a newbie to this board :p

I recently sent the first letter to HSBC to reclaim my DH's charges.
They have replied with the bog standard letter saying that the charges are on hold etc so DH rang them to go down the hardship route on the basis we have a court date for none payment of council tax and also our BT line has been terminated (although that is a whole other story) and also as his charges are more than £500 per year.

They have told him that he has to fill in an income and expenditure form and then call them back to discuss - and then they will pass it to our local branch who will arrange to see us. This is the bit I don't understand? Is this correct? I am a bit dubious as last time we tried to discuss our finances in the branch we were told quite rudely 'that we had to manage our money better' by a girl who couldn't have been more than 19/20 as well all know this is easier said than done.

So my question is really 'what do i do now?'

Good afternoon and please help if possible.

My DH has just contacted HSBC to go down the financial hardship route and the man on the phone has told him outright that we do not qualify as the loans we have, caused ourselves to go into financial hardship although we have had to get loans just to pay the bills etc.

He did offer DH a management loan that he refused point blank at which point the man on the phone became quite rude and basically told him that he was no longer willing to help. DH explained that the loans were to pay bills etc and that we have a court date for un payed council tax etc and also we have more than £500 of charges per year (more like £500 every 4/5 months) at which point the man said that that was not a reason and he had never heard such rubbish and didn't know who had been feeding us such lines! DH asked for a copy of the criteria list and also a letter confirming that they disagree with the hardship and was told no and this was now the end of the conversation and wait until the ruling, he then hung up.

So my question this time is: What do I do now? So upset to be spoken to like that.

    I don't understand why they are telling you to deal with the local branch which to me sounds like they are going Managed Loan area which I would not touch with a barge pole. In fact I would prefer to sell one of my organs than go that route.

    Have they sent you an I&E form? If so fill it in and then phone them. They will go through it with you over the phone to assess whether you meet their FH criteria.

    Hi,
    Natwestmember, This is what we thought as this is what they tried to do when we went to see them a while ago and I definately do not want to go down this route.

    Orford, No they haven't so they are sending one out today (hopefully) however, I also have the feeling that they will not be most helpful and will tell us that we don't meet the criteria - if that happens what do I do next?

    Sorry for all the questions but really want to make sure I do this correctly and as I no longer have the net at home I am having to have a quick look during my lunch break at work.

    Sorry if I waffled too much.

    Yes we filled in the I&E form and then rang them.HSBC have refused to look at us being in hardship telling us we do not qualify (please see above the reasons why we think we are in hardship) and have told us to wait for the ruling. DH asked for a letter showing the criteria needed to be met and also the reason why they disagree - they have refused to do either, so the question is ...... What do I do now as they won't do anything other than tell us to wait, can I appeal this?

    I also want to point out that the man on the phone refused all requests as soon as we turned down their debt management plan of ten years!!!!
