argos grrr...

Hi , I brought a home cinema system from argos in january , and still have the receipt. Acouple of weeks ago it went wrong , so i rang argos who then gave me a number of the repairers. i rang and made an appointment for them to pick it up which they did. A few days later , they said they could not reapair it and would bring it back to me so i could take it too the store i purchased it from and get a replacement . So today i go to argos only to be told they dont sell that product anymore , but a newer upgraded one which is 90 pounds more expensive , which they expected me to pay. I wasn't happy about this decision and asked to see the manager , who was not apparently in the store. The assistant rang panasonic for me to ask if they could get hold of any more , he said no , but the repairs on this product are relatively cheap . So why wasn't it just repaired ? I have written an email to them and await a reply , but would like to know my rights . They have offered me a refund , but i got the item in a sale with 100 pounds off so wont be able to replace it with the refunded money . I have brought it back home with me as i didnt think them asking me for another 90 pound on an updated system , because they dont sell the one i brought anymore was unfair .

Personally I would take the money and then find the item in another sale, either in Argos or elsewhere. I think they have been fair since you have had the use of it since January.make the most of it, we are only here for the weekend.

I have a guarentee for a year , so i don't think its fair at all , i'm happy for them to repair it .After all if you brought a tv you wouldnt expect it too last 6 months would u ?0

If youre quite happy to have it repaired then just hang on and wait for the reply. they were presumably running out of stock at Arogs of the item which is presumably why they have these sales to get rid of end of line stuff.
I swear by Panasonic and am really surprised it breaking down.

Hows it not fair? You where offered a refund, It was on sale at the time, Tough titties.0 -
It's annoying, rather than unfair I think. It's the nature of electronic goods that you can rarely go back and get the same model again 6 months later.0

By the sound of it you have purchased an item classed as "R.O" - running out, so stores won't be getting any more stock in as it would have been end of line - anything that is reduced in price dramatically like that is usually R.O.
In terms of replacement value, under the Sale of Goods Act retailers aren't obliged to give you a different higher value item if they are unable to repair or replace a faulty item. It lies into economies of scale, so in your case:
(a) Repairs are not possible or disproportionally costly,
(b) A replacement isn't possible as the item is no longer stocked, and to exchange it for the next item up would again be disproportionally costly,
(b) A full refund to your original tender.
If they aren't able to find you a repair agent, maybe you could ask as a gesture of goodwill if they will meet you part way with the cost of the new unit?
