Ebay sold as new when clearly used

Hi,

I bought a Hard Drive two days ago on ebay. It arrived today and when i opened it, it was clearly used. Marks, old partitions, and most alarmingly a clicking sound meaning its not long for this world.

Looking back over the feedback it seems they have a habit of doing this (although they have 99.7%) and when people complain they have to fund the shipping themselves.

Now I dont want to do this. I dont see why i should fork out £4, because they made the mistake. Do I have rights as a consumer not to pay for shipping costs or is this at the discretion of the seller.

I know it's only £4, but they were trying to cheat me, this is clearly from about 1999, so they would have easily known, and I dont want to help a cheater.:A

    even if you go through a paypal claim you will be told to return the item at your own cost for a refund. Good sellers will refund the returdn postage but they do not have to.

    So you need to decide wether its worth your while returning it. You can always make your opinions known via Feedback DSRs

    The % on feedback can be misleading as if sellers sell a lot of items they can still have a lot of negs and have a high %. Your better off actually looking through the feedback and checking why they got the negs. Also check there DSRs

    Look at it this way; if the seller won't refund the return postage, then they're buying themselves a negative.

    So if you don't get a full refund, leave a factual negative.

    DO NOT use negative feedback as a bargaining tool to get the return postage back, as he can use this to have any neg removed. (and you'll still be out of pocket)

    was it a BIN or an auction. If it was a buy it now then the seller (which I assume to be a business) has to refund the return postage under the DSR (Distance Selling Regulations) as the item isn't as described or fit for purpose etc.

    I sent an item back yesterday and if she does not refund everything I've paid out, I won't hesitate to leave a neg. First time I've ever had to do this BTW.

    They/we/I don't have to so they/we/I don't.

    Simple as that.

    I'll only pay a refund on return postage if I've sold a faulty item and only once I have it back and inspected it but that's through choice as I'm not obliged to.

    As for neg's, only the anally retentive care about them.

    Very, very few sellers will pay for return postage.

    Twice I've asked for a refund (opn auctions) and both sellers offered to refund my return postage.

    On neither occassion did I send the item back as both items under £10 and a waste of my time returning, I just wanted to know whether I should leave a neg or no feedback at all.

    Businesses selling via BIN however have to (by law) pay for return postage if the item is faulty or not as described. They may try to wriggle out of it however.
