ASTHMA and dla

i currently unfit to work due to ill health and have lost my job as recommended by my consultant that the job was an adding factor to my ill health as well as having had phnewmonia last november.

i am considdering claiming dla but dont know how to word it or go about answering the questions, as my illness causes the physical disabilty's walking eating drinking preparing a cooked meal etc changes hour to hour because the illness is so unpredictable has anyone gone through this and have been awarded the benefit as they have asthma too or know anyone who can offer me support i have been to cab and was unsuccessfull the last time i dont want to muck this up this time round as my care needs changed when i caught phnewmonia and having lose my job i'm all depressed and things i cannot cope with a big battle with benefits agency and doctors controdicting things that my gp and consultant says. any help can be appretiated i have helped other people with disability's get dla i just cant seem to do it for myself. probably as you dont notice your disibilty as much as you carry on day to day coping with it.

  • Ask the CAB to help you fill out the forms again. You should have appealed it when you got turned down. DLA forms are very labourious to fill out and you should get help face to face with it rather than over the internet.

    Its vertually impossible to claim DLA for ashma alone, even the most severe form but it is remotely possible.

    My sister was awarded DLA a year before she died for ashma and the complication of prescribed steroid use but 99.99999% of ashmatics are fit for work and even after having phumonia they are not eligable for DLA.

    My sister died when she was 34 and thats how bad you have to be to get DLA for ashma.

    i have had severe asthma for 23 years and i was refused DLA a while back.
    Vegetarian's Do Not!!!! eat fish :mad:

  • i know it's verry hard to claim dla period for any 1 with asthma hell i know someone who hasnt any legs get awarded middle rate appeal to get higher rate and was down graded to lower rate on appeal. thats how [EMAIL="f@@@ked"]f@@@ked[/EMAIL] the system is but its not the phnewmonia that im claiming for it's the cause of new complications that i have now got and one of the main reasons why i was effectivly retired from any work. it is dissabling for me and i struggle everyday up n down stairs walking lifting carrying e.t.c.

    mealone im sorry to hear that your sister passed away because of asthma i too have come close to going the same fate twice infact i have gone into cardiac arrest and have been rescusitated, second time i was nerly pronounced dead if it werent for the doc shocking me one last time.

    i have helped many people get the DLA benefit because they were entitled to it.

    but they didnt have asthma.

    i been to CAB who last filled in the form and it was refused due to being under medicated and my GP'S report (he filled it in wrongly) but i didnt appeal because stress forces a attack and to go through a few months of stress could effect my chest in a massive way.

    i am starting to fill in the form now on the comp, my mum is helping also,
    i think its a matter of wording it correctly. kianicky you claimed but refused why not try again but ask people who knows you best to advise you on what you can and cant do when your having an attack,

    i cant cook my self a main meal (and cooking a ready in the microwave dont count as the questions asked if all the ingrediants were provided that you have to use to prepare (chop potatoes etc) a main mean and then cook it at the cooker) i cant because the steam and the heat in the kitchen effects my chest too badly. asnwering no to this question garentees a lower rate payment of dla if medicas is passed and remember your to ill to go to a medical they have to come to you thats where you have homeground advantage your assesed at the second you enter their premises if you attend their clinic mind. my advice to you is re-apply for dla and word it differently they dont want your dieing day but an avarage day good nore bad i now this dont make sense but thats how they base the claim on an avarage day.

    asthma is a hidden condition that causes physical problems, it's not the illness we asthmatics try to claim for but THE LEVEL OF DISIBLITY it causes.

    hence the benefits name "disibilty living allownce" allot of people think that because a limb is missing or there is obvious physical defects that only people with these problems can claim it.

    as you may have whitnessed that asthma comes with other problems reoccuring chest infections scarring of the lungs because of caughing all the time and mucus build up unpredictabilty of an attack, difference in heat hot to cold cold to hot triggers it off winter is hard for sufferers as its allways cold people get cold flu and us sufferers pick up infections if we even go near them. the figure that 99.9999% of asthmatics are fit to work is totaly inaccurate.

    2002-2002 and so on what would you ask me? Why have you left so many jobs?
    so many jobs not held for no more than a few months because of excessive sick leave i have to say. would you employ me compared to someone who held a job more than three years. us sufferers are practically un-employable because we are ill this was one of the basis i was retired as i have had that many jobs i have been sacked from due to my ill health my consultant has seen me 1. unfit to work due to my worsening condition,
    2.un-employable due to excessive sick leave.

    i do not mean to have a go but many people do not see things in a way we do.

    In this appeal, a tribunal did not accept that asthma prevented the claimant from cooking. Don't know if this means a precedent has been set which is now always used as a judgement.

    Ventilating the kitchen and oven using a fan, by opening a window or using a cooker hood, plus using lids on pans, should go along way to minimising your exposure to heat and steam.

    I have to agree on this point, a relatively modern kitchen should have sufficient ventilation etc so as not to let the steam and heat affect you. I am just learning to cook again due to (a different) illness, and the key is to adapt the cooking process to suit you. It may take you longer than others to prepare a meal, but it should not be impossible.

    OP, your employment record is not of interest to the DLA people. Be careful not to confuse DLA with ESA or IB, which are more concerned with work. Also, I cannot understand a lot of what you have written. A clearly written application will certainly do no harm, so I would get help in this respect.

    You might want to consider returning to education to improve your skills and train for something that you can do which will not affect your asthma. This should cost you very little if you're on means tested benefits.

    Definitely try CAB, i went today and finally got help with my form!

    i am aware of this apeal and it was overuled by another tribunal by another person as the panel claimed that the claiment could use ready meals in a microwave for a main meal to elimanate steam and heat when challenged at another apeal the panel found for the claiment and throwing this judgment out as a reay meal is not a main meal and hand prepared and cooked on a cooker, by opening windows useing pan tops i come back to hot and cold air that irretates my chest and who wants to open a window when its pouring down with rain to get the floor wet and worktops my windows in the kitchen are obove my worktops and opening them in the rain would ruin any food preparation. so again a judge thinking stupid and i would of challenged that in the tribunal.
