LLOYDS TSB LOAN....advice needed again please?

    I'm sure there's no problem discussing this over the phone, You have their agreement in writing about the monthly payments. Just ring them and say that you are waiting their instructions in writing about how to repay the agreed amount.

    i hope i dont get slated for being unresponsible again as i do know i was irresponsible and hold my hands up...but;

    after another phone call from lloyds tsb who assured me they would send a paying in book through the post or some payment slips - i told they i wanted to pay by cash over their counter

    nothing came so;

    i wrote to them asking them for the payment slips and put a detailed log off all communication to/fro each other

    still nothing.....

    now - today i have received a letter from robinson way ltd asking for full and final settlement (added £499 on somehow)....

    so - what do i do now? do i send a detailed log again to them though of all communications with lloyds?

    part of me wishes it would go to court then i could sort it once and for all - i really do want to pay the money back and am not trying to get off as i was accused of before...

    Agreed - and if you look at other posts I've done you'll see that I have helped in the past and been thanked a few times also.

    You'll notice in all those posts though the poster doesn't defer all repsonsibility to the other party. Statements like its their fault, how can they do this are just whinging.

    The facts are simple, the loan is outstanding, and the OP remains liable for it until paid back or written off. Now if they want advice on how to achieve either of these options we can move forward, however it seems more like the OP only really wants their ego stroked by a group of others who think its okay to not pay and blame the banks.

    So lets get on with the business of trying to solve the problem and quit with the trying to balme others bit.

    Fully agree. Some people think that its the banks fault they physically signed the dotted line.

    You should have just confirmed on the phone that you'll start paying when they send the paying in book. At the end of the day if you already have the letter confirming acceptance then they cannot sell the debt nor can they add a default or pursue a CCJ. As you're not paying, and they are now chasing it, forget the letter right now and pay them the 4 late payments (£20) or you run the risk of a default.

    Pride goes out the window, you simply agree that you never paid cos you're waiting on the paying in book. Can they please send it asap, in the meantime can you pay £20 using card or can you send a PO/Cheque in?

    Thats what i'd be doing (and I have a lot of experience in this field ;))... If they do default you right now, nothing you can do. Therefore may I politely suggest you commence payments asap and stop playing silly beggars with them :D

    neverindoubt - im not playing silly beggars hun - i honestly dont know how to pay...i was advised not to pay by cheque or by credit card with my new bank details on - nor should i set up direct debit or standing order....just to pay cash in bank...so - how can i pay that if i dont have a book??????
  • Okay - so I take your point but I'd liketo counter that it's peopl elike YOU who have made it diificult for the rest of the country to get finance agreed. Swings and Roundabouts.

    Absolute nonsense! It is people with an attitude such as yours (i.e. that doesn;t have a clue so shouts wild accusations about) that make matters worse! The reason we're in a recession is primarily due to the sub prime mortgage lending and banks refusing to lend between each other. The short term regulated agreements that are unsecured debt has little bearing on a bank whatsoever and any losses are written off as part of their annual assessment of P&L.

    There is no evidence that people behind on credit cards & loans have caused the recession or banks to refuse lending! Please get your facts right.
    It isn't their fault you took out a loan and didn't pay it. I'm not saying that it's all yours either, just that you can't complain that they want what is theirs back

    Its actually ours (the taxpayers) but beyond that, if they forced a loan on him then actually he does have recourse to refuse to pay. It depends on numerous factors, but suffice to say if the OP started with say a £1000 overdraft and charges etc made it to £3k then they forced a loan onto him i'd guarantee to be able to get the whole lot revoked because of the numerous breaches that would have occured. As I say, I am familiar with this process and the unenforceability and CCA processes and legalities and would welcome any valid discussion you have but please don't give people a guilt trip when you're actually way off the mark with your ridicule in the first place :D

    Ok, so give them a ring and agree to pay DD and let them take it. They know your bank details cos they will be listed on your credit report (i.e. they can see who you bank with) but they cannot take money without your knowledge and the DD guarantee protects you.

    I'm not having a go either, but I am saying get in touch and be proactive otherwise you'll find you're in bigger bother with a default and they are a nightmare to get removed.

    I'm only offering my advice - it's up to you what you do with it :D

    thanks never in doubt - i do feel stupid and guilty to find myself in this situation and it makes me feel worse when i ask for advice and get slated by people like vaporate.....i dont want to make excuses but, at the time of the loan i was in a real bad place - dad had died/i was mums and oh's full time carer with kids to look after too...then mum died and i needed money for her funeral and other expenses (ok we had some help from government but never enough)

    hence, i got myself into a mess which im trying my best to get out of - i only have this loan to sort now....

    it was on legalbeagles that i was advised not to part with any new banking details hence, i took that advice and am waiting for a paying in book....

    Listen don't worry about things, the lender can only get what you offer or they default you - no big deal (even though it seems it right now)..... pointless blaming yourself, just think 'time to sort this mess out' and move forward - trust me, this will be a minor blip in your life! :D

    I'd still pay with DD at least this way you have proof and protection when you pay. Its the best way forward - just ring them and say you were awaiting a book, it never came so can you set up DD to take £5 per month. Ask for them to post you a DD mandate - alternatively, get their bank details and your reference and send via S/O from your bank to theirs once a month.

    Whatever you do, don't fall out with people on here - Vaporate is actually alright but is entitled to his own opinion and whilst I agree some people would be better served shutting up, he isn't one of them..... Just chill out, you'll be back on the straight and narrow in no time :D
