does anyone else have any advice on this please?

what happens if it gets sold on? will they still accept a small offer of repayment?

surely it is their fault really...but, should i be chasing them?

    thanks

It's your fault you spent the money.

They may be behaving like amateurs, but you are the one who is bound to make repayments so take some responsibility

I agree with you about the negative comments, I have been a lurker on here, registered yesterday and offered help and got slated!!!

Anyway onto your 3k, it is in your best interests to contact them. You have the agreement and chances are they will tell you they posted something out to you, its lost in the post, its not their fault and sell it on as advised above. The chances of you paying your agreed amount then is probably zero!!

Give them a call or pop into the branch and pay your first fiver.

housebuyer - its people like you who have chased all the decent folk away from moneysavingexpert and made it crap now - we could come here for help and advice at one time and not get slated or sneered on....we dont all own our own business and have £150k to spare and that - some people find it hard to get by and when circumstances arise to get extra money to make your life easier you take it - ok it dont always work out right but, we try....

Okay - so I take your point but I'd liketo counter that it's peopl elike YOU who have made it diificult for the rest of the country to get finance agreed. Swings and Roundabouts.

It isn't their fault you took out a loan and didn't pay it. I'm not saying that it's all yours either, just that you can't complain that they want what is theirs back

Yeah i think if people come on here looking for advice they don't really need someone telling them they've messed up to be honest! Not really very productive and it will just drive people away from the site and the people who genuinely want to try and help out, rather than stroking their already over-inflated ego and sense of self importance...

Agreed - and if you look at other posts I've done you'll see that I have helped in the past and been thanked a few times also.

You'll notice in all those posts though the poster doesn't defer all repsonsibility to the other party. Statements like its their fault, how can they do this are just whinging.

The facts are simple, the loan is outstanding, and the OP remains liable for it until paid back or written off. Now if they want advice on how to achieve either of these options we can move forward, however it seems more like the OP only really wants their ego stroked by a group of others who think its okay to not pay and blame the banks.

So lets get on with the business of trying to solve the problem and quit with the trying to balme others bit.

Can you state why it is their fault, it may then be possible to give some advice on your next move.

    to recap i have an agreement to pay back a £3,000 loan back to lloyds at £5 a month - the letters have been going backwards and forwards before they accepted this - basic fact was i should never have been able to get to £3,000 overdrawn and then have them make me take out a loan to pay it back....hence, they agreed £5 a month about 4 months ago....but;

i never received a paying in book or a confirmation letter to say this agreement had been put in place

the last communication said the offer was accepted and confirmation and payment details will be forwarded to me

but now i have just had a phone call asking me when im going to start paying - i told her i wouldnt discuss it over the phone and to put it in writing

should i have gone into why i havent paid or should i just wait for the letter? should i be chasing them for when/how i should pay or would that just be doing their job for them?

thanks - i feel like im being awkward but i know you shouldnt discuss anything over the phone...

Okay - so to start again...

You've done it right. Everything need to be in writing now as a paper-trail in case they decide to get aggressive.

I would write to them, stating the agreement you made previously (dates as well if you can) can re-iterate that you are happy to make payments at these levels if they can instruct you how to make them.

They will most likely accept (probably with a bit of toing-and-froing whilst they try to get you to up the amount) because they won't want to have to explain why they let you get so overdrawn in the first place (responsible lending and all that)
