    This is specifically for the FSA which is complaining that lloydsTSB did not comply with the FSA waiver. It is not about dealing with the hardship claim but complaining about how LloydsTSB breached the waiver in your case(hope that bit makes sense).

    Right, so it wont really help my case then, but i am going to complain anyways.

    Let's put it this way, the FSA monitor the FSA Waiver and if people do not complain about breaches as they see it to the FSA Waiver then nothing will change. From August 2008 to July 2009 they had exactly 18 complaints so it's not exactly an avalanche of breaches is it?
    Keep that email in mind when you are reading the threads cos if you spot something which you think is a breach of the FSA Waiver then get people to complain to the FSA about it and specifically why they believe it has been breached, ok? ;)

    I was given a number concerning my hardship case to call Lloyds TSB and i could not get through to them, i ended up leaving my details on a answering machine with a promise that Lloyds would phone back within 48 hours.

    When the call came it cut off immediately, there was no such call made to me and every time i asked Lloyds for a expenses form they gave me the same 0845 number to call, they have made it impossible for me to get a final response for my case and therefore impossible for me to go to the FOS with a final response. The call made to me lasted 0.02 seconds, an immediate cut off.

    Before I went to FOS I complained to Lloyds under hardship and they didn't send me an I&E form to complete or ask any information about why it was financial hardship, just told me they aren't paying back any bank charges until OFT case completed.

    They told me they were applying charges for that month in excess of £200 and although I had a 'gold' account which I requested to be cancelled 3 months prior to reclaiming due to hardship my cancellation was under review and told me they would be charging me the £12 for the account for that month until cancellation was approved by my local Lloyds branch! (thus charging me another £35 for being over OD for that £12 charge)

    Surely I can tell FSA that I think that is breach?

    It's not a breach because the bank does not have to send out an I&E form because that is only required where they cannot change assess you from their own records. HOWEVER, that fee paying account IS a separate issue if you requested it to be cancelled. Write to their head office about that part of it.
