Chased by Lloyds whilst account with FOS

Hi,

I have tried searching to see if this has been asked before but unable to find anything.

I am reclaiming bank charges under hardship with FOS, however my bank, Lloyds TSB keep writing to me demanding payment.

Can they do this whilst the account is under complaint? Anyone have any letters I could use?

    Yes they can, however, you could write to them and tell them theres no way you can pay the fee as you are in hardship, you have more important things to pay first. Keep a copy of your letter and send that to the FOS as well, i wish i had thought of more things like this when i put my claims in, i omitted a lot of info and it went against me i think.

    So are the FOS, i recieved a letter yesterday from them asking for more information, i posted my letters off early this morning with more information and a hour later the mail arrives, another letter from the FOS saying it has reviewed my case and Lloyds have treated me fairly - how unprofessional and silly is that?

    I also got a letter from Lloyds telling me to phone them within 7 days, the letter was 7 days old when i got it - thy both are unbelieveably dumb and uncaring, they got my new information and so i am going to see what happens, i think they are both trying to fob customers off.

    Unless you have LloydsTSB final Response letter outlining their decision so you can go to the FOS then it would have been difficult to overturn their decision.

    I do not have a final response off Lloyds TSB no. I am going on the other advice you gave me about unfair treatment, taking my cash when i am on benefits and not giving me a alternative - i believe i was treated unfair and Lloyds can't give me a final response if they make cut off calls to me lasting less than a micro second or send me any kind of expenses form, they have made it impossible on purpose to either get through to them or get a final decision.

    Yes you did the utilities rent arrears thing ages ago LOL :D I can only try and see what happens, i believe if had i been given my charges back i would of still had a tenency and my debts would not have snowballed, FOS have now got this info and i am hoping for a positive response, its gone past wanting my charges now, this is about consumer revenge of unfair treatment!!!

  • If they sent you the expenses form, then you needed to have completed it and sent it back(I am sure you would have sent in an Income and expenditure anyways, right?)

    No, Lloyds wanted to do it over the phone but as i said, they hung up on me and have also hung up on other people on this forum. I recieved a expenses form today from the FOS i will fill it in anyways and send it off, however, its very late i could have done with this a year ago when i was in crisis.

    OK, email this issue to: centralwaiversteam@fsa.gov.uk
    They are monitoring the FSA Waiver. Mention hanging up taking an I&E form over the phone and no written final response to financial hardship.

    This is specifically for the FSA which is complaining that lloydsTSB did not comply with the FSA waiver. It is not about dealing with the hardship claim but complaining about how LloydsTSB breached the waiver in your case(hope that bit makes sense).
