    The answer is "money". As I said on another thread the DVLA seems to be prostituting itself to make a quick buck.

    A complaint against DVLA for abusing data protection law in this way is currently being investigated by the Information Commissioner's Office ( this is the organisation that is responsible for policing the Data Protection Act). This is not a fast-moving organisation so the outcome may not be known for several months.

    For anyone who is interested, the results will be made available via Martin's site as soon as they are known. If the complaint is upheld it may open the way for anyone whose data has not been adequately protected by DVLA to lodge their own retrospective complaint.

  • I am the joint owner of a private car park behind a block of flats.We charge £25 per month for parking. There are 10 spaces, most of which(before we acquired the car park,rented out the spaces and employed a clamping company), used to be occupied either by commuters using a nearby tube station or by abandoned cars.The situation has greatly improved as a result of the activities of the clamping company but we are not happy because :
    a) the clamping company charges offenders much more than can be justified as a deterrent and insists on clamping being followed within the shortest possible time by removal of the offending vehicle,thus ensuring that the maximum of £430 is almost always levied;they say that if left, the clamps are often destroyed.

    b) the high level of charges gives us as owners of the car park a bad reputation with the tenants of the flats - it is not generally appreciated that we receive no part of the fines.

    c) the clamping company will not commit to (or report to us on) the specific regularity of their patrols and we have the impression that when they have "made their money for the year" they cease to patrol.The whole system is certainly very "hit and miss" as regards catching those who trespass by parking on our property,especially at the weekend.

    d) they refuse to pass on to us to help maintain the car park, any of part of the huge profit they undoubtedly make.

    e) none of the clamping companies we contacted operated any differently: all stated that they levy charges in line with those recommended by the BPA.As a result,there is no competition,we,the client have no choice and there is a effectively a cartel operating.

    The alternative of a barrier is not realistic.Anything other than a manual barrier (which would pose problems for our disabled customers) costs a lot more than we could afford,would be vandalised and requires electricity.

    This is an example of theft and they should be reported to the police by you immediately. In Scotland of course, it also counts as extrotion. Regardless of what some so called 'legal experts' also say about the Human Rights Act, it is a violation of those basic human rights which our recent ancestors fought and died fighting for, in World War 2.

    Consider these rights as belonging to you by virtue of their sacrifice and the Universal Declaration of Human Rights in 1948 e.g:-

    Article 1
    All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood
    Article 2
    Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status

    Everyone has the right to life, liberty and security of person

    No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment

    Then consider how many of them are violated by such cowboy clampers who are allegedly acting legally and with State sanction? Nothing they appear to be doing complies with the BPA Code either. But under Articles 1 & 30 above the clampers and 'trespassing cars' are all violating anothers rights. The State along with all UN Member States were supposed to make National and International Laws to protect these rights but even they failed to do so since 1948. This State ignores many Covenants which were also meant to protect them too. Even the RAC proposals, which a link to was provided by someone else, don't give enough consideration to them.

    How would you feel you had been treated by one of these crooks?

    Having spent several hours ploughing through this I don't think any of this RAC report author's recommendations make any sense, but he does say he's a barrister, so that explains his biased position. He's clearly thinking of all the work in it for his profession.

    The only matter of relevance is the difference between Scotish and English Law, the latter of which fails to uphold many human rights. So why set up any 'bodies' to licence; regulate or arbitrate on appeals against totally unfair penalties or 'charges' when all that needs to be done is for the Government to abolish them entirely, as in Scotland. I don't even support State 'bodies' issuing arbitrary and immediate penalties either, as it still violates your right to a hearing first, which is a basic human right even recognised by Article 6 of the European Convention.

    The differences between Scottish & English (&Welsh) laws also violate the second paragraph of Article 2 of the Universal Declaration, which the UK proposed in 1948, namely:-
    "Furthermore, no distinction shall be made on the basis of the political, jurisdictional or international status of the country or territory to which a person belongs, whether it be independent, trust, non-self-governing or under any other limitation of sovereignty."

    That report does highlight the fact that the Government is looking for ways to support these cowboys, cheats and thieves soon, so the time for revolt is now. Please write to your MP by email (to avoid postal strike delays) quoting your name and address, so he takes account of your 'vote' on it, and tell him of your own personal experiences, if he doesn't already know. You should be able to find his contact details at the local library if not on the parliament.uk website.

    Just to prove a point I am at the moment in dispute with a PPC. I parked legally in a free shoppers car park. I did not stay longer than the two hours and did not leave the area. I had a PCN on my car which just stated that I was parked in the car park, it did not state why it had been issued. So would anyone pay up to any company who affixed a request for money on your car without stating the reason for it? I wrote to the compnay, so did my MP, who I contacted asking why it had been issued. Their reply was 'it was being dealt with by their appeals department' SEVEN MONTHS later I received a letter saying the appeal had been rejected and suddenly 'causing an obstruction' has appeared. How can you cause an obstruction parked in a row of cars facing a wall!!!!!! Times are hard PPC are 'ticketing' cars parked legally trying to get money. Will ignore everything they send me.

    To all the people complaining....DO something about it....don't pay the scammers who issue tickets that have no right in law and go to the small claims if you get clamped....

    no law is broken...there is no law for these scammers to use they just use ignorance of THE LAW...dont part with your hard earned money just think the tickets as trophys....one day these scum company's will go out of business (for want of a better word)once the public wakes up to the fact that its a con.

    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
