can I get a refund?

I ordered some wall lights from a Department store in Birmingham, I picked them from a catalogue as they didn't have any on display.

2 Days later I telephoned the store to cancel my order, not a problem, however, you will need to come into the store to sign for the refund to go on to your credit card.

The problem with this is I live 100 miles away, I explained this to the store manager - they keep saying I have to go into store.

Does anyone know a way around this?

    If they agreed for a refund I cant see how you need to go back, sounds like a cop out to me

    It sounds like you have spoken to a trainee. Call again ask to speak to the manager/supervisor explain your problem and tell them you wish to cancel the order and want a full refund in line with your rights under the distance selling regulations.

    You didn't have to go into the store to buy the lights and you don't need to go in to get a refund.

    You should really cancel in writing so it would be advisable to follow up your conversation by email or letter as well. That way if you have further problems you have written proof of your actions

    The OP's post sounds like they were in the store when they ordered them?

    Can you confirm if you ordered them in-store or over the phone / internet etc, as it does make a big difference.

    They don't need your signature for a refund they can do 'cardholder not present' I would infrom them of that next time you call and they should sort it out. :)

    The distance selling regulations do not apply as the lights were selected and paid in store.

    There is no reason why they cannot refund without you there. Just ask to speak to someone more senior.

    Keep in mind, however. They are doing you a favour here, it's not a legal right, so be nice!
  • Your signature on any letter you send them should satisfy whatever red tape they have governing their accounts refund procedure.

    A lot of new chip and pin machines in stores do not have this option as they are set up to sell with card present and the chip used. If you try and type in a code an error comes up and says it is a chipped card and must be inserted. New data protection laws mean stores do not even have the card details available to them so it is conceivable that the store cannot put the money back on the card without the card being present in the machine. There could always be a deal done with refunding to vouchers but that may not be what the OP wants. Birmingham is nice though, see if they will let you delay the refund until you want to go back. It's nearly Christmas you know....
