ESA Medical

  • Asked it I could have a print out of all information written about me directly after the interview. Denied. Put tape recorder on desk and informed the doctor that I would be recording the interview. NOT ALLOWED. Ended up being read the same blurb about....
The recording must be made by a professional operator, on equipment of a high standard, properly calibrated by a qualified engineer immediately prior to the recording being made. The equipment must have facility for reproduction so that all parties can retain a copy of the tape. etc
I have stated that I want to record. New appointment booked for 2nd Sept. No money to afford professional, just trying to protect myself after hearing what has happened to others. This can't be right! Help!!!!

My father has been on ESA for a few months now and has just had the decision on a "Limited Capability for work assessment" to which he was awarded 12 points, 3 short of the needed 15 to be allowed the benefit. I should point out that this is the 3rd time he has had a medical and they have ruled him fit to work. He has appealed to all three, won quite a few and lost 2. Illness wise he has Degenerative disc disease (lower back and neck-diagnosis from specialist consultant), incontinence, sleep problems, walking difficulty and depression. As my father has a chequered history with these medical I decided to go his latest one and record the interview he had. Probably illegal but, was needed to cover our back in the eventuality that he didn’t get enough points! In the recording I made, you can clearly hear my dad saying that he has all the problems above, but in his decision letter it hasn’t awarded him for:

Bending or kneeling (which he couldn't do )

I see that the proposed changes to the Work Capability Assessment which looks like being approved has removed the Bending and Kneeling activity along with many other changes e.g. The Walking test has been changed to Mobilising so you could be assessed as being able to use a wheelchair even if you don't use one and the Picking Up activity has removed the use of hands to carry out this activity!!

Yes that is correct you cannot record the medical unless it is carried out by a professional as detailed above.

Whilst I don't agree with all the proposed changes, surely if someone is capable of being mobile by using a wheelchair they should do so? If the alternative is to be housebound, it seems like a no brainer?
    Gone ... or have I?

I believe that the DWP can, and do, make covert recordings (mainly video?) of claimants that they suspect of fraud. Not 100% on this, but pretty sure I've heard that they do. Perhaps someone knows for sure?

Point is, surely the reverse is then allowable, that a claimant who suspects DWP/ATOS of fraud, can make covert recordings? Perhaps that's why claimants recordings have been allowed in the cases mentioned on this thread.

It's certainly taken them long enough to decide that then; so it's nothing to do with all of a sudden the government wanting fewer people to pass the ESA medical assessment so they can save money

Trouble with that is that there are people like me for whom things are more complicated than this. For instance, sometimes i'm too ill to even get out of bed, and times when I have an overwhelming need to lie down/sleep. Maybe they will suggest I get a reclining wheelchair?:rotfl:

The new harsher WCA doesn't appear to take into account fluctuating conditions, ergo stand by for an increase in the number of appeals lodged and possibly won, as it is 40% are successful.
