hes stopped paying....again...criminal compliance?

well dunno what he said to my caseworker on the phone but he has got himself referred straight to criminal compliance.....

It can't just have been his usual refusal to pay because he has done that several times, waiting until the sheriff officers had to deliver his court papers, 4 wks, then another 3mths to court date, 6page letter of guff into the court about how he loves his children (just not prepared to aliment them or see them) then 2 continuations later he paid all his arrears off!!

that was in April and he managed May and June before stopping his payments.......

what happens now? i would love to see him banged up but they probably have a few more stages to go through before they do that ;)

    CC is about either not supplying information or giving the wrong informatiom it has a max pen of £1000 so he not going to jail. The complaint ie the offence must be brought within 6 months of the offence.

    Now the real story about CC its a way of making a Pwc OR nrP feel they are in the loop.

    The test ask your case officer when the offence was commited not what the offence was but only when it was committed then ask when the interview under caution took place.

    oh yeah! really! i have tried to explain to him the severe hardship that he has caused me and the children by not paying his maintenance but he ignores it, i have struggled to feed, clothe and keep my children safe because of him and i would like to say that he earns a huge amount of money, in his first year of operation he earned in excess of 65k and bought a sports car with a private reg, then refuses to pay his £500 amonth assessment, even on a DEO he has refused to pay so the only thing that would likely work is something more serious like the driving license or committal proceedings he is a law unto himself........he doesn't see his kids now, hasnt since January he couldnt even be bothered to call his daughter on her birthday not even a card, how could she be worse off? so yeah banged up would be a great wake up call..........

    Thanks CMAC i just didnt know what sort of thing this could be, his arrears are only about £400 so being fined £1000 seems a bit pointless!

    It is probably failure to provide info or having provided false info. The arrears are dealt with by enforcement not criminal compliance.

    But if he goes to jail, how is he going to pay you anything? If he loses his driving license, he might have trouble getting to work and might lose his job so again he will not be able to pay you anything.

    That isn't the point Trevor - the point is that he probably won't want to go to prison and will probably pay up - that is the reason that they have it; got to have some disincentive to not pay!!

    What I'm saying is the OP is saying they want him to go to jail, but then in the same breath they are saying that when he didn't pay it caused severe hardship. So if the OP gets what she wants and he goes to jail or loses his driving license, then it will only cause more severe hardship. This will affect the child also. Punish him and you punish the child.

    So if the OP gets what they want, the child will suffer basically. What should be looked at is if there are any other ways to punish the NRP while allowing him to continue paying, not just looking at ways to punish the NRP.

    Glad you see sense too Trevor, it stands to reason that in the case above, the OP 's ex is not going to pay up, prison threat or not :(

    The point is that he is unlikely to go to prison if he wants to maintain his own life - if he wants to take the chance, then he has more to lose than the PWC - he will think very hard about his actions. If he isn't paying then the PWC can't get any worse off.
