Can I just clarify..... If someone claims DLA and IB, they can also claim Income support? What if the person doesnt live alone and the other person works 22.5hrs a week?

No. He would have to demonstrate, on the balance of probabilities, that he did not make the claim due to a failure by the DWP. Whether that was the wrong advice, a lack of advice or the adviser not asking the right questions is irrelevant.0 -

It confuses people when people open up new threads, especially when the OP has not been online for several weeks.

when you used to be able to claim Incapacity Benefit it clearly stated on the back of the form to make a claim to Income Support as you may be entitled. there would have been a tear off slip to put your details on and send to your local office for them to issue you an income support claim form. (this was the case in northern ireland..not sure about england/scotland/wales) that was them telling you that you should of made a claim even if noone specifically told you to, it is up to the person that is claiming to read the form thoughougly. when anyone ever made a claim to income support and asked for it to be backdated to the date of their incapacity claim it was always knocked back if they jus said that they wernt told to claim it. income support will only backdate a claim if you can prove that you could not reasonably be expected to make a claim earlier. and as you filled in an incapacity benefit form which told you to also make a claim to income support you were informed. BUT still ask for the backdating its always worth a try
