how much dose the law say is the ammount i need to live on?

i am 25 on medium care and low mobility dla and on long term sick on incapacity benefit i get 100 pound a week... i had a call from the crisis loan people who i had made a claim to who said he had looked at all my money and i should be also getting income support and should of been from 2 years ago which is when i first went onto incapacity benefit...dose anyone no anyother info on this? i am 25 single and live on my own with no carrers x:confused::confused:

    I am on exactly the same benefits as you. I get long term IB, MRC and LRM DLA.

    IB should total £105.45 a week

    As you receive DLA, live alone and have no carers you get two disability premiums which topup your Income Support allowance. IS would total £144.65 a week. But as you get IB the two totals are subtracted and you should be getting £39.20 a week Income Support as a top up.

    Did you ever claim for income support and, if so, what happened at the time?

  • You need to make a claim now, and ask for a backdate for the full period. I would seriously suggest you seek legal advice on this one, as the DWP would have had a duty to tell you to claim Income Support for the top-up. You may also be entitled to backdated council and housing benefit, and if this is due to a failure by the DWP, you would be entitled to the full period back on this.

  • funny you should say that i got 2 grand at begining of the year coz ohusing benefit was underpaying me i presumed it was underpaying me coz of my dla maybe it was because of this but they didnt mention...

    Well, were you given the wrong advice or did you simply not apply for it? The two situations are quite different.
  • wrong advice as i rang up told them the situation and they should of made a claim for me for both not just incap so the man said to me
